It is the Commission’s opinion that, by introducing a new rightholder, apart from the “producer of the first fixation” of a film (who holds the exclusive rights under the terms of Article 2 of the Directive), Portuguese law adds an element which could impair the functioning of the Internal Market insofar as it makes it more difficult, firstly, for economic operators interested in the work to know who to contact to obtain a licence to exploit it, and, secondly, for artists and performers to identify from whom they have the right to be paid for each copy of the work sold.
La Commission est d’avis qu’en introduisant un nouvel ayant droit différent du «producteur de la première fixation» des films (qui est le responsable final aux termes de l’article 2 de la directive), la loi portugaise introduit un élément de possible dysfonctionnement dans le marché intérieur, dans la mesure où cela rend plus difficile, d’une part, pour les opérateurs économiques intéressés à l’ouvrage de savoir à qui s’adresser pour obtenir une licence d’exploitation et, d’autre part, pour les artistes et interprètes de savoir auprès de qui ils sont en droit d’obtenir une rémunération pour chaque commercialisation de l’ouvrage.
