2. It also shows that, given the length of waiting lists, the absence of such action will mean that there is very little chance of patients receiving the organs they need.

Directive 2003/54/EC of the European Parliament and of the Council of 26 June 2003 concerning common rules for the internal market in electricity and Regulation (EC) No 1228/2003 of the European Parliament and of the Council of 26 June 2003 on conditions for access to the network for cross-border exchanges in electricity have made significant contributions towards the creation of such an internal market in electricity.

4. The Agency shall, based on matters of fact, provide a duly reasoned opinion as well as recommendations to the ENTSO for Electricity, the ENTSO for Gas, the European Parliament, the Council and the Commission, where it considers that the draft annual work programme or the draft non-binding 10-year network development plan submitted to it in accordance with the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] do not contribute to non-discrimination, effective competition and the efficient functioning of the market or a sufficient level of cross-border interconnection open to third-party access, or are not in compliance with the relevant provisions of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] or Directive 2009/./EC [concerning common rules for the internal market in electricity] and Directive 2009/./EC [concerning common rules for the internal market in natural gas].

The purpose of the Regulation is to stimulate cross-border exchanges in electricity by establishing a compensation mechanism for transit flows of electricity and by introducing harmonised principles on cross-border transmission charges and the allocation of available interconnection capacities between national transmission systems.
