Pleas in law: Infringement of Rule 50(1) of Commission Regulation No 2868/95 and Articles 76, 8 and 8(2)(c) of Council Regulation No 207/2009, as the Board of Appeal: (i) has neglected its right to examine the facts of its own motion, and take into consideration facts that are apparently likely to affect the outcome of the opposition; (ii) erred in law when it did not consider that ‘PIERRE ROBERT’ is a well known mark; (iii) failed when not considering the evidence, Annex 1, which was submitted in connection with the filing of the opposition; and (iv) failed when not accepting the certificate from the Swedish Patent and Registration Office filed before the decision of the opposition division.
Moyens invoqués: Violation de la règle 50, paragraphe 1, du règlement no 2868/95 de la Commission, et des articles 76, paragraphe 8, et 8, paragraphe 2, sous c), du règlement no 207/2009 du Conseil, en ce que la chambre de recours: i) a négligé son droit d’examiner d’office les faits et de prendre en compte des faits qui seraient apparemment susceptibles d’affecter le résultat de l’opposition; ii) a commis une erreur en droit en ne considérant pas la marque «PIERRE ROBERT» comme une marque renommée; iii) a omis de prendre en considération les éléments de preuve (joints en Annexe 1) en rapport avec l’introduction de l’opposition; et iv) n’a pas accepté le certificat émanant du bureau suédois des brevets produit avant que la division d’opposition rende sa décision.

That, at the conclusion of tomorrow’s debate on the Bloc Québécois' opposition motion, all questions necessary to dispose of the motion be deemed put and a recorded division deemed requested and deferred until Wednesday, April 29, 2009, at 3:00 p.m.; and that the deferred recorded division on the second reading stage of Bill C-241 in the name of the member for Brome—Missisquoi and the deferred recorded division on Motion M-294 in the name of the member for Vaudreuil- Soulanges, currently scheduled immediately before the time provided for private members business on Wednesday, April 29, 2009, be deferred anew following the vote on the Bloc Québécois' opposition motion on the same day.
Que, à la conclusion du débat de demain sur la motion d'opposition du Bloc québécois, toutes questions nécessaires pour disposer de cette motion soient réputées mises aux voix et que le vote par appel nominal soit réputé demandé et différé jusqu'au mercredi 29 avril 2009 à 15 h; que le vote par appel nominal différé en deuxième lecture du projet de loi C-241, au nom du député de Brome-Missisquoi, et que le vote par appel nominal différé sur la motion M-294, au nom de la députée de Vaudreuil-Soulanges, prévus à l'heure actuelle avant la période prévue pour les Affaires émanant des députés le mercredi 29 avril 2009, soient différés à nouveau immédiatement après le vote sur la motion d'opposition du Bloc québécois la même journée.

– (PT) I am voting for this motion for a resolution, and would express the same conviction as the rapporteur that awarding the title of European Capital of Culture to a city which was the site of such tragic events in the course of the 20th century would be an important step towards transcending historical European divisions and showcasing the new Europe.
– (PT) J’ai voté pour cette proposition de résolution et je voudrais, à l’instar de la rapporteure, indiquer que le fait de décerner le titre de capitale européenne de la culture à une ville fut le théâtre de tant d’événements tragiques au XXe siècle permettrait d’accomplir un pas important en vue de dépasser les divisions que l’Europe a connues par le passé, et de mettre en valeur la Nouvelle Europe.

In this context we should welcome the motion of the Commission on reducing the administrative burden as regards reporting and documentation requirements in the case of mergers and divisions.
Dans ce contexte, nous devons saluer la proposition de la Commission visant à réduire les charges administratives liées aux obligations en matière de rapports et de documentation en cas de fusions ou de scissions.

We regret not being able to support this motion in the final vote because we are even in agreement with the first two paragraphs, and we agree that the time has come to update the division of competences between the Union and its Member States on the basis of the principles of subsidiarity and proportionality, in order to take account of the lessons of the Community's history – particularly those lessons that unfortunately point to so many excesses and infringements of the principle of subsidiarity.
