Although those figures do not match exactly the number of EEAS officials in each grade, since some of those officials were not eligible for promotion during that promotion procedure, they provide adequate proof that, although the vacancy notice had confined the opportunity to apply for the vacant post solely to EEAS officials in grade AD 5, nearly all EEAS officials would have been excluded from the selection procedure, in view of the high grades occupied by all those officials.
S’il est vrai que ces chiffres ne coïncident pas exactement avec le nombre de fonctionnaires du SEAE classés dans chaque grade, puisque certains de ces fonctionnaires n’étaient pas promouvables lors dudit exercice de promotion, ils prouvent à suffisance de droit que, si l’avis de vacance avait limité aux seuls fonctionnaires du SEAE de grade AD 5 la possibilité de présenter leur candidature au poste à pourvoir, la presque totalité des fonctionnaires du SEAE aurait été exclue de la procédure de sélection, au vu du grade élevé auquel tous ces fonctionnaires sont classés.

It is apparent moreover from the data supplied by the applicant himself that, in the 2013 promotion procedure, 15 officials of the EEAS were eligible for promotion to grade AD 6; 18 officials were eligible for promotion to grade AD 7; 15 officials were eligible for promotion to grade AD 8; 26 officials were eligible for promotion to grade AD 9 and the same number were eligible for promotion to grade AD 10; 47 officials were eligible for promotion to grade AD 11; 33 officials were eligible for promotion to grade AD 12; 130 officials were eligible for promotion to grade AD 13 and 102 officials were eligible for promotion to grade AD 14.

9. Stresses that the role of EU Special Representatives (EUSRs) should generally be to represent and coordinate EU policy towards regions with specific strategic or security interests for the EU which require a continuous EU presence and visibility; takes the view that close coordination must be established between the EUSRs and the relevant EEAS departments and that important thematic issues, previously covered by Personal Representatives, should be reconsidered and proposals put forward for this role to be taken over by high-ranking EEAS officials or EUSRs; considers it essential that defining the role and mandates of EUSRs be made subject to prior consultation of Parliament and that proposals be put forward, in accordance with Article 36(1) of the TEU, on the procedures and remit for the briefings and reports to be made available to Parliament by EUSRs;

Until 30 June 2014, with regard to those officials who have been transferred to the EEAS pursuant to Council Decision 2010/427/EU, by way of derogation from Articles 4 and 29 of these Staff Regulations and under the conditions set out in Article 7(1), the Appointing Authorities of the institutions concerned may in exceptional cases, acting by common agreement and solely in the interest of the service, after having heard the official concerned, transfer such an EEAS official from the EEAS to a vacant post of the same grade in the General Secretariat of the Council or in the Commission without notifying the staff of the vacant post.

(7a) Until 30 June 2014, with regard to those officials from the General Secretariat of the Council or from the Commission who have been transferred to the EEAS during the start-up phase, it should be possible to transfer such EEAS officials without their post, in the interest of the service, from the EEAS to the Council or the Commission.
(7 bis) Jusqu'au 30 juin 2014, en ce qui concerne les fonctionnaires du secrétariat général du Conseil ou de la Commission qui ont été transférés au SEAE lors de la phase de lancement, il devrait être possible de transférer ces fonctionnaires du SEAE sans leur poste, dans l'intérêt du service, du SEAE au Conseil ou à la Commission.
