(38) In order to facilitate a smooth transition to the entry into application of this Regulation, market practices existing before the entry into force of this Regulation and accepted by competent authorities in accordance with Commission Regulation (EC) No 2273/2003 of 22 December 2003 implementing Directive 2003/6/EC of the European Parliament and of the Council as regards exemptions for buy-back programmes and stabilisation of financial instruments for the purpose of applying point 2(a) of Article 1 of Directive 2003/6/EC, may remain applicable until one year after the date specified for effective application of this Regulation provided that they are notified to ESMA.
(38) En vue de faciliter la transition jusqu'à la mise en application du présent règlement, les pratiques de marché existant avant l'entrée en vigueur du présent règlement et acceptées par les autorités compétentes conformément au règlement (CE) n° 2273/2003 de la Commission du 22 décembre 2003 portant modalités d'application de la directive 2003/6/CE du Parlement européen et du Conseil en ce qui concerne les dérogations prévues pour les programmes de rachat et la stabilisation d'instruments financiers pour l'application de l'article 1, paragraphe 2, point a), de la directive 2003/6/CE, peuvent rester applicables jusqu'à un an après la date indiquée pour l'application effective du présent règlement, à condition d'en informer l'Autorité européenne des marchés financiers (AEMF).

Those delegated acts shall ensure that ESMA is able to act, where appropriate, on a precautionary basis and shall not be required to wait until the product or financial instrument has been marketed or the type of activity or practice has been undertaken before taking action.

To that end, as from the entry into force of the national laws, regulations and administrative provisions necessary to comply with this Directive and until the issuance of the opinion of ESMA referred to in point (a) of paragraph 1, the competent authorities of the Member States shall, quarterly, provide ESMA with information on the AIFMs that are managing and/or marketing AIFs under their supervision, either under the application of the passport regime provided for in this Directive or under their national regimes, and with information needed for the assessment of the elements referred to in paragraph 2.

À cette fin, à compter de l’entrée en vigueur des lois et des dispositions réglementaires et administratives nationales nécessaires pour se conformer à la présente directive et jusqu’à ce que l’AEMF émette l’avis visé au paragraphe 1, point a), les autorités compétentes des États membres fournissent chaque trimestre à l’AEMF des informations relatives aux gestionnaires qui gèrent et/ou commercialisent les FIA placés sous leur surveillance, soit dans le cadre du système du passeport prévu par la présente directive, soit conformément à leurs systèmes nationaux, et les informations nécessaires à l’évaluation des éléments visés au paragraphe 2.

To that end, as from the entry into force of the delegated act referred to in Article 67(6) and until the issuance of the ESMA opinion referred to in point (a) of paragraph 1 of this Article, the competent authorities shall, quarterly, provide ESMA with information on the AIFMs that are managing and/or marketing AIFs under their supervision, either under the application of the passport regime provided for in this Directive, or under their national regimes.
