Since the objectives of this Regulation, namely, to enhance the fight against offences affecting the financial interests of the Union by setting up the EPPO, cannot be sufficiently achieved by the Member States of the European Union, given the fragmentation of national prosecutions in the area of offences committed against the Union’s financial interests but can rather, by reason of the fact that the EPPO is to have competence to prosecute such offences, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 TEU.

3. When taking measures in accordance with this Regulation and deciding on the seriousness and effect of the relevant actions or omissions on safety and the environment the Commission shall take into account national measures already taken on the basis of the same facts against the recognised organisation concerned, in particular where that organisation has already been subject to judicial or enforcement proceedings.

Thus, neither the fact that, in its decision ruling on an administrative complaint, an institution or agency responded to the substantive arguments put forward without touching on the possibility that the complaint had been submitted out of time and was therefore inadmissible nor the fact that that institution or agency expressly informed the person concerned that he had the option of contesting that decision before the courts has any effect on the Civil Service Tribunal’s assessment of whether the action subsequently brought against that decision is inadmissible: facts of that kind are not capable of establishing a derogation from the system of mandatory time-limits established by Articles 90 and 91 of the Staff Regulations, still less of exempting the Tribunal from its obligation to verify that the time-limits laid down in those regulations have been complied with.

in the alternative, in the event that the Court of Justice should take the view that the fact that that action is brought against the CJEU and not against the Commission (as the representative of the European Union) has no bearing on its admissibility but that the General Court, in its decision on the procedural issue raised before it by the CJEU, should have ordered that the CJEU be replaced by the Commission as defendant, refer the case back to the General Court to enable it to give judgment on Kendrion’s action for damages in the light of the legal assessment of the Court of Justice;

Even if claims directed against a decision of the Appeals Committee of the European Investment Bank have the effect of bringing before the Union judicature an appraisal report against which an administrative appeal has been lodged, that fact is not, in itself, a reason for the Union court to confine itself to considering the claims against the contested report, or to omit entirely to review the validity of the Appeals Committee’s decision, in so far as the Committee has full power of review authorising it to substitute its assessments for those contained in the report, a power on which the Civil Service Tribunal, on the other hand, cannot rely.

Recognises attempts by the Council and the Commission to organise a second round of the European Union-Uzbekistan dialogue on human rights in May 2008 and commends the Commission on its efforts to organise a civil society seminar on media expression in the margins of the dialogue, possibly in Tashkent; points out once again that the holding of a dialogue on human rights and experts' meetings on the 2005 Andijan massacre do not in themselves constitute progress and cannot be used as a reason for the lifting of sanctions; notes that the absence of an independent international inquiry into the Andijan massacre and the lack of any improvement in the human rights situation in Uzbekistan — these being the conditions laid down by the European Union for the lifting of sanctions — have logically led to the sanctions against Uzbekistan being extended; welcomes the fact that the conclusions of the General Affairs and External Relations Council of 15-16 October 2007 have introduced specific conditions which have to be met within a period of six months in order for the visa restriction suspension to be maintained; invites the Council and the Commission to carry out a serious assessment of the impact of the decision to suspend for six months some of the visa restrictions that form part of the European Union sanctions against Uzbekistan, and to review the overall human rights situation in the country; deplores the fact that Uzbekistan has so far failed to deliver any progress in any of these respects; pays tribute to the work done by its Subcommittee on Human Rights in closely monitoring the human rights situation every six months so as to provide the Council with regular parliamentary assessments and recommendations as regards the EU policy to be adopted in this matter; is appalled by the presidential election held on 23 December 2007 in Uzbekistan, which according to the ODIHR was ‘held in a strictly controlled political environment, leaving no room for real opposition, a ...

Member States shall apply the provisions of this Directive without any discrimination in form or in fact against foreign ships and in accordance with applicable international law, including Section 7 of Part XII of the 1982 United Nations Convention on the Law of the Sea, and they shall promptly notify the flag State of the vessel and any other State concerned of measures taken in accordance with this Directive.
