Must Article 4 of Council Directive 85/374/EEC (1) of 25 July 1985 on the approximation of the laws, regulations and administrative provisions of the Member States concerning liability for defective products be interpreted as precluding, in the area of liability of pharmaceutical laboratories for the vaccines that they manufacture, a method of proof by which the court ruling on the merits, in the exercise of its exclusive jurisdiction to appraise the facts, may consider that the facts relied on by the applicant constitute serious, specific and consistent presumptions capable of proving the defect in the vaccine and the existence of a causal relationship between it and the disease, notwithstanding the finding that medical research does not establish a relationship between the vaccine and the occurrence of the disease?

Would it perhaps be possible for a debate to be conducted in the Czech Republic regarding what in fact they find troubling about this treaty and what alternatives President Klaus could offer the people of Europe to quell the current dissatisfaction, to which he indeed vociferously refers, and what solutions he would envision? At present, all that is known is that he wants to prevent the reform but is putting forward no positive proposals.
Serait-il possible de mener un débat en République tchèque sur ce que les Tchèques trouvent dérangeant dans ce traité, quelles alternatives le président Klaus pourrait offrir au peuple européen pour endiguer le manque actuel de satisfaction, auquel il fait référence avec véhémence, et quelles solutions il imaginerait? Actuellement, tout ce que l’on sait, c’est qu’il veut éviter la réforme, mais il n’avance aucune proposition positive.

As someone who has many friends and relatives in many of these poorer countries, I think we have to look no further than the governments of many of these countries: poor governance issues; state monopolies and corrupt governments that are preventing entrepreneurs in these countries from creating wealth; the fact that they find it difficult to import the materials that they need to add value and create wealth; also the fact that many citizens of the countries are denied access to goods and services that we take for granted here in the EU and in many richer countries.
Ayant beaucoup d’amis et de famille dans bon nombre de ces pays pauvres, je pense qu’il n’est pas besoin de chercher le problème plus loin que dans les gouvernements de nombre de ces pays: une mauvaise gouvernance, des monopoles d’État et des gouvernements corrompus qui empêchent les entrepreneurs locaux de créer de la richesse, les difficultés pour importer les matières nécessaires pour créer de la valeur ajoutée et des richesses, de même que le manque d’accès de nombreux citoyens à des biens et des services que nous prenons pour acquis ici dans l’UE et dans une grande partie des pays riches.

I believe that what unites us in this debate is simple: it is the defence of our citizens, the fact that we can all agree that we must stand guard over our citizens’ rights; that we act as their shield, and that when they find themselves having to deal with unfair authorities and unjust bureaucratic procedures, they should not be made to feel abandoned.

The requested State is bound by the findings as to the facts in so far as they are stated in the decision or in so far as it is impliedly based on them (Article 42).

At the time of conversion, the relevant authority: a) shall be bound by the findings as to the facts insofar as they appear explicitly or implicitly from the judgment imposed in the sentencing State; b) may not convert a custodial sentence to a financial sentence; c) shall deduct the full period of deprivation of liberty served by the sentenced person; and d) shall not aggravate the penal position of the sentenced person, and shall not be bound by any minimum which the law of the administering State may provide for the offence or offences committed.
