First, the appellants argue that the General Court disregarded its obligation to state reasons in failing to address the second part of the plea alleging infringement by the Commission of its obligation to open the formal investigation procedure provided for in Article 108(2) TFEU relating to the conclusions inferred from the commitments undertaken by the French authorities, indicating serious difficulties encountered by the Commission and on the basis of which the Commission was required to open the formal investigation procedure.
En premier lieu, les parties requérantes considèrent que le Tribunal a méconnu son obligation de motivation, en ce qu’il n’a pas répondu à la branche du moyen tiré de la violation, par la Commission de son obligation d’ouvrir la procédure formelle d’examen prévue à l’article 108, paragraphe 2, TFUE, relative à l’indice tiré des engagements pris par les autorités françaises, témoignant d’une difficulté sérieuse rencontrée par la Commission et sur le fondement de laquelle la Commission était tenue d’ouvrir une telle procédure formelle d’examen.

Initiating the State aid investigation procedure would therefore ignore the legitimate expectations that the French authorities had placed in the Sernam 2 Decision, especially as they had acted with total transparency in relation to the Commission, providing it with all the relevant explanations on the terms and conditions of this disposal.

As mentioned in recital 4, a number of French producers were subject to a French court proceeding into anti-competitive behaviour due to which it was considered appropriate to initiate ex officio an interim review to re-examine the injury situation of the Union industry in particular in comparison to the situation which prevailed in the investigation period of the original investigation.
Comme indiqué au considérant 4, certains producteurs français ont été mis en cause dans une procédure judiciaire ouverte en France pour comportement anticoncurrentiel, raison pour laquelle il a été jugé approprié d’ouvrir d’office un réexamen intermédiaire afin de réexaminer le préjudice subi par l’industrie de l’Union, en particulier par rapport à la situation qui prévalait durant la période d’enquête initiale.

In addition, following a French court proceeding into anti-competitive behaviour of a number of French producers of okoumé plywood, it was considered that it could not be excluded that this could have had distorted the injury assessment in the original investigation.
Par ailleurs, à la suite de la mise en cause d’un certain nombre de producteurs français de contreplaqué d’okoumé dans une procédure judiciaire ouverte en France pour comportement anticoncurrentiel, il a été considéré qu’il ne pouvait être exclu qu’un tel comportement ait pu fausser l’appréciation du préjudice lors de l’enquête initiale.

Based on the above analysis, it is concluded that the anti-competitive behaviour of French producers did not affect the injury situation of the Union industry in particular in comparison to the situation which prevailed in the investigation period of the original investigation.
Compte tenu de l’analyse qui précède, il est conclu que le comportement anticoncurrentiel de certains producteurs français n’a pas eu d’influence sur le préjudice subi par l’industrie de l’Union, en particulier par rapport à la situation qui prévalait durant la période d’enquête initiale.
