(13) In order better to ensure that, amongst other things, third countries grant Community carriers comparable treatment, a procedure should be established enabling the Community more efficiently to take action against third countries which do not grant treatment comparable to that granted in the Community.

(c) grants air carriers from other third countries more favourable treatment than Community air carriers,
c) accorde aux transporteurs aériens d'autres pays tiers un traitement plus favorable que celui qu'il accorde aux transporteurs aériens communautaires,

(b) does not grant Community air carriers de facto national treatment, or
b) n'accorde pas de facto aux transporteurs aériens communautaires le traitement national, ou

(c) "Community carrier" means an air carrier with a valid operating licence granted by a Member State in accordance with the provisions of Council Regulation (EEC) No 2407/92 of 23 July 1992 on licensing of air carriers(5).

Even if an agreement grants rights to Community carriers, if it also limits designation to one Community carrier on routes between a Member State and a third country or between individual cities in the two parties, it will completely undermine the rights of Community carriers under the Treaty.
Même si un accord accorde des droits à des transporteurs communautaires, s'il limite également la désignation à un transporteur communautaire sur les liaisons entre un État membre et un pays tiers ou entre deux villes de chaque partie, il compromet totalement les droits dont jouissent les transporteurs communautaires en vertu du traité.

11. Since the conditions for the granting of air carrier's licences are harmonised at Community level in the third package, it has to be considered that any Community carrier within the meaning of Council Regulation 2407/92 [9] who can show that he has a place of business (subsidiary, branch or agency) in the territory of a Member State must be able to exercise traffic rights from that State to a third country in the same manner and on the same terms as carriers which are nationals of the Member State in question.

Compte tenu de l'harmonisation au niveau communautaire des conditions pour l'octroi de licences de transporteur aérien intervenue dans le troisième paquet, il y a lieu de considérer que tout transporteur communautaire au sens du Règlement 2407/92 [9] qui peut justifier d'un établissement (filiale, succursale ou agence) sur le territoire d'un Etat membre doit pouvoir exercer des droits de trafic au départ de cet Etat vers un pays tiers au même titre et dans les mêmes conditions que les transporteurs ressortissants de l'Etat membre en question.
