The Hague Programme on strengthening freedom, security and justice in the European Union, which was approved by the European Council at its meeting on 4 and 5 November 2004, requires Member States to consider legislation on conflicts of jurisdiction, with a view to increasing the efficiency of prosecutions while guaranteeing the proper administration of justice, so as to complete the comprehensive programme of measures to implement the principle of mutual recognition of judicial decisions in criminal matters.
Le programme de La Haye visant à renforcer la liberté, la sécurité et la justice dans l’Union européenne, approuvé lors du Conseil européen réuni les 4 et 5 novembre 2004, appelle les États membres à envisager de légiférer en matière de conflits de compétence, afin d’accroître l’efficacité des poursuites tout en garantissant une bonne administration de la justice, de manière à mener à bien le programme global de mesures destiné à mettre en œuvre le principe de reconnaissance mutuelle des décisions pénales.

In view of the increasing mobility of citizens and in order to ensure the proper administration of justice within the Union and to ensure that a genuine connecting factor exists between the succession and the Member State in which jurisdiction is exercised, this Regulation should provide that the general connecting factor for the purposes of determining both jurisdiction and the applicable law should be the habitual residence of the deceased at the time of death.
Compte tenu de la mobilité croissante des citoyens et afin d'assurer une bonne administration de la justice au sein de l'Union et de veiller à ce qu'un lien de rattachement réel existe entre la succession et l'État membre dans lequel la compétence est exercée, le présent règlement devrait prévoir que le facteur général de rattachement aux fins de la détermination, tant de la compétence que de la loi applicable, est la résidence habituelle du défunt au moment du décès.

Member States shall require their nationals, persons subject to their jurisdiction and firms incorporated in their territories or subject to their jurisdiction to exercise vigilance when doing business with entities incorporated in Libya or subject to Libya's jurisdiction, and any individuals and entities acting on their behalf or at their direction, and entities owned or controlled by them, with a view to preventing business that could contribute to violence and the use of force against civilians’.
Les États membres exigent de leurs ressortissants, des personnes relevant de leur juridiction et des sociétés constituées sur leur territoire ou relevant de leur juridiction qu'ils fassent preuve de vigilance dans leurs échanges avec des entités constituées en sociétés en Libye ou relevant de la juridiction libyenne et avec toute personne ou entité agissant pour leur compte ou sous leurs ordres ainsi qu'avec les entités qui sont en leur possession ou sous leur contrôle, afin d'empêcher des échanges qui pourraient contribuer à la violence ou à l'emploi de la force contre les civils».

1. This Regulation shall apply without prejudice to subsequent application to the courts having jurisdiction with a view to further compensation.
