Establishing a monitoring and risk analysis centre with the capacity to monitor migratory flows towards and within the European Union and to carry out risk analysis which is to be applied by Member States and which covers all aspects relevant to integrated border management, in particular, border control, return, irregular secondary movements of third-country nationals with the European Union, the prevention of cross-border crime including facilitation of irregular immigration, trafficking in human beings and terrorism, as well as the situation at neighbouring third countries with a view to developing a pre-warning mechanism which analyses the migratory flows towards the EU.

In order to determine whether the economic equilibrium and the availability and quality of a public service contract would be compromised, the relevant regulatory body or bodies referred to in Article 55 shall make an objective economic, social and environmental analysis, including an analysis of the employment situation and conditions, and base its decision on pre-determined criteria.

Article 4 of the proposed directive lays down a general obligation for Member States to take measures necessary to establish an appropriate monitoring programme, Article 5 requires Member States to set parametric values for monitoring radioactive substances and Articles 6 to 8 concern methods of monitoring, sampling and analysis to be applied by Member States.

These requirements have also been strengthened by Parliament’s amendments, of which the following stand out: the obligation to comply with environmental legislation by participating companies, establishing more demanding standards for the qualification and training of the environmental verifiers who accredit the companies, public reports on the environmental performance of companies, with absolute credibility for third parties, greater involvement of the interested parties in the process of monitoring the environmental performance of companies and, in particular, of employees and users, extension of environmental responsibility, which goes beyond the company’s facilities, to include indicators of the performance of products and services, in line with the approach of the new environmental directives, and also an increase in the role of the coordinating bodies with the aim of facilitating the homogenous application of the system in the various Member States.
De même, ces conditions requises ont été renforcées par les amendements du Parlement, parmi lesquels on peut distinguer : l'obligation, pour les entreprises qui ont adhéré au système, de respecter la législation environnementale ; l'établissement de normes plus strictes en ce qui concerne les qualifications et la formation des vérificateurs environnementaux qui accréditent les entreprises ; l'élaboration de rapports publics relatifs au comportement des entreprises à l'égard de l'environnement et dotés d'une crédibilité absolue face à des tiers ; une plus grande implication des parties intéressées à la procédure de contrôle et de suivi du comportement des entreprises à l'égard de l'environnement, tout particulièrement des travailleurs et de leurs représentants ; un élargissement de la responsabilité environnementale, dépassant le cadre des installations de l'entreprise et incluant des indicateurs de comportement relatifs aux produits et aux services, conformément à l'approche des nouvelles directives environnementales ; et, pour terminer, un renforcement du rôle des organes de coordination dans le but de pouvoir appliquer le système de manière homogène dans les différents États membres.
