M. considérant que douze prisonniers politiques sont encore en détention en Biélorussie, dont Ales Bialiatski, défenseur des droits de l'homme et vice-président de la Fédération internationale des droits de l'homme, Mikalaï Statkevitch, candidat sélectionné pour le prix Nobel de la paix, candidat sélectionné pour le prix Sakharov pour la liberté de l'esprit du Parlement européen et ancien candidat à la présidence, et Zmitser Dashkevitch, dirigeant de l'organisation de jeunesse «Front de la Jeunesse» («Malady Front »);

– having regard to its award of the 2009 Sakharov Prize for the Freedom of Thought to Memorial, a Russian non-governmental organisation campaigning, inter alia, for the rights of political prisoners in Russia, and having regard to the growing support in the European Parliament for ‘Memorial’ as a candidate for the Nobel Peace Prize,
– vu la remise du prix Sakharov 2009 pour la liberté de l'esprit à "Memorial", une organisation russe non gouvernementale luttant notamment pour la défense des droits des prisonniers politiques en Russie, et vu le soutien croissant, au sein de l'Assemblée, à une candidature de "Memorial" au prix Nobel de la paix,

D. whereas the Burmese Government has included in the draft constitution provisions which reserve one quarter of the seats in both houses of parliament for military officers, give the country's military chief the right to suspend the constitution at any time and bar candidates from running for president if they have a foreign spouse or child (which would apply to the detained opposition leader of the National League for Democracy (NLD) and winner of the Nobel Peace Prize and Sakharov Prize, Aung San Suu Kyi); whereas the draft constitution also offers impunity for state agents for acts committed in office,
D. considérant que le projet de Constitution du gouvernement birman réserve un quart des sièges dans les deux assemblées parlementaires à des gradés de l'armée, donne au chef militaire du pays le droit de suspendre la Constitution à tout moment et interdit aux candidats ayant un époux ou un enfant étranger de se présenter à l'élection présidentielle (ce qui s'appliquerait à Aung San Suu Kyi, dirigeante de la Ligue nationale pour la démocratie (LND) dans l'opposition, et lauréate du prix Nobel de la paix et du prix Sakharov, en détention); considérant que le projet de Constitution assure aussi l'impunité aux fonctionnaires pour les actes commis dans l'exercice de leurs fonctions,
