IN-CONTEXT TRANSLATIONS

In order to make applicant countries more familiar with the various concepts of Private Public Partnerships and inter-municipal co-operation in the management and financing of public utilities, the Austrian "Federal Ministry for Agriculture, Forestry, Environment and Water Management" and the Commission (DG Regional Policy and DG Environment) organised a joint seminar in Vienna on 17 and 18 September 2001 with participants from many countries both within the existing European Union and the Candidate Countries.
Afin de familiariser les pays candidats aux différents types de partenariats public-privé et à la coopération intercommunale en matière de gestion et de financement de services d'utilité publique, le ministère fédéral autrichien de l'agriculture, de la sylviculture, de l'environnement et de la gestion des eaux et la Commission (DG Politique régionale et DG Environnement) ont organisé un séminaire conjoint à Vienne les 17 et 18 septembre 2001.

As regards the amendment tabled by the Group of the Alliance of Liberals and Democrats for Europe, I should like to add that, whilst the local authorities presumably welcome the fact that they are to enjoy cooperation free of red tape, ultimately, the case law of the European Court of Justice does not provide any genuinely clear guidelines regarding the opportunities for inter-municipal cooperation or public–public partnerships either in Spain or Traxa.

There is a further field that must be mentioned when it comes to legal uncertainty, and that is the unresolved problem of public cooperation – known as ‘inter-municipal cooperation’ in Germany.

Moving on to inter-municipal cooperation, the second contentious point, I believe it to be self-evident that the municipalities should not in any way be hampered in their management of their own affairs, but equally self-evident, too, that this cannot mean that public/private partnerships should be generally exempted from the obligation to put work out to tender.

21. Considers in this connection – with a view to potential efficiency gains from the involvement of new operators and new forms of general interest service provision – that there is an urgent need for greater legal certainty concerning the differing forms of inter-municipal organisations (involving cooperation between municipalities, self-provision in the context of in-house procurement, public-private partnership, award of concessions), for a clarification of the scope of the EC law relating to competition, public procurement and State aid, and for universal criteria that are valid throughout the EU;
21. demande, dans ce contexte et dans l'intérêt d'éventuels gains d'efficacité dus à l'arrivée de nouvelles entreprises et à la création de nouvelles formes de fourniture de services d'intérêt général, la garantie d'urgence d'une plus grande sécurité juridique à l'intention des diverses formes d'organisation intercommunale (coopération intercommunale, prestations propres dans le cadre d'"opérations internes", partenariats public-privé, marchés concédés) et la clarification du champ d'application du droit européen de la concurrence, des marchés publics et des aides d'État, ainsi que des critères valables à caractère générique et transeuropéen;
