On 11 February 2014 the Commission adopted Decision 2014/883/EU (4) finding the State aid which Poland had unlawfully granted to Gdynia-Kosakowo Airport Ltd and the State aid which Poland was planning to grant to that airport operator to be incompatible with the internal market.

By that question, the national court is in substance asking whether it is contrary to Community law for domestic legislation to permit unduly paid Community subsidies not to be recovered, on the basis, assuming that the recipient's good faith is established, of criteria such as loss of enrichment, where the recipient had already, at the time when the subsidy was granted, passed on the pecuniary advantage resulting from it by paying the target price provided for under Community legislation and any right of recourse against his suppliers would be worthless.
Par cette question, la juridiction nationale demande en substance si le droit communautaire s'oppose à ce qu'une réglementation nationale permette d'exclure la répétition d'aides communautaires indûment versées, en prenant en considération, à condition que soit établie la bonne foi du bénéficiaire, des critères tels que la disparition de l'enrichissement dans un cas où le bénéficiaire a déjà, au moment où l'aide a été octroyée, transféré l'avantage patrimonial qui en résulte en payant le prix indicatif prévu par le droit communautaire et où un éventuel droit de recours à l'encontre de ses fournisseurs serait dénué de toute utilité.
