The rapporteur proposes leaving the graduated rules on jurisdiction proposed by the Commission with regard to the varying arrangements between the Member States on registered partnerships unchanged. For Member States which do not recognise registered partnerships, the proposal provides that courts in such States may decline jurisdiction. However, if they do not, courts may not generally invoke public policy as a reason not to allow foreign law on partnerships to be applied.
Au demeurant, votre rapporteure ne modifie pas le dispositif progressif concernant la compétence judiciaire prévu par la Commission dans sa proposition, compte tenu de la diversité des positions des États membres vis-à-vis des partenariats enregistrés: pour les États membres qui ne connaissent pas le partenariat enregistré, la proposition prévoit que leurs juridictions nationales peuvent décliner leur compétence; mais si une juridiction ne choisit pas cette option, elle ne peut rejeter d'une manière générale l'application d'un droit étranger relatif au partenariat en se prévalant de l'ordre public.

To this end, your Rapporteur proposes to increase the market surveillance in distance selling through ensuring that all relevant information requirements are also displayed in electronic commerce, to establish an annual information requirement of Member States to the Commission about their market surveillance activities, to call on the Member States to provide the adequate funding to their market surveillance authorities. Finally, the Rapporteur stressed the need for appropriate actions to be taken by the Member States against improper use of CE marking.

The rapporteur draws the legislator's attention to the fact that the simple replacement in Articles 38 and 39 of the VAT Directive of the term "supply of gas through the natural gas distribution system" by the term "supply of gas by pipeline or by vessel for transporting natural gas" does not take away completely the ambiguity of the text. Furthermore, although the terms in the relevant provisions change, the title of Section IV of Chapter 1 of Title V, where these provisions are included, remains unchanged ("Supply of goods through distribution systems"). Finally, and in order to respond to concerns expressed about the coverage under the proposed wording, the rapporteur proposes to specify that trasnsport by vessel should be "from pipeline to pipeline".
Enfin, et pour répondre aux préoccupations exprimées concernant le champ d'application couvert selon le libellé proposé, le rapporteur suggère de préciser que le transport par navire devrait se faire "de gazoduc à gazoduc". Le Conseil devrait saisir cette occasion pour supprimer toute ambiguïté dans le texte final.

The rapporteur proposed to split the proposal in such a way that the necessary prolongation of the transitional measures could be adopted in June 2005 in a first reading agreement with Council. The rest of the proposal kept pending for discussions in Parliaments first reading in order to allow a profound discussion on potential changes.
