1. Member States may require undertakings referred to in point (a) of Article 1(1) which are governed by their laws and which are members having unlimited liability of any undertaking referred to in point (b) of Article 1(1) (‧the undertaking concerned‧), to draw up, have audited and publish, with their own financial statements, the financial statements of the undertaking concerned in accordance with this Directive; in such case the requirements of this Directive shall not apply to the undertaking concerned.

5. Member States may require undertakings other than small undertakings to disclose information in their annual financial statements which is additional to that required pursuant to this Directive.

1. Member States shall require undertakings and public interest entities to prepare and make public a report on activities in each country in which they operate, including of payments made to governments, on an annual basis where those undertakings or entities meet or exceed two of the following criteria:

In order to carry out the duties assigned to it by this Regulation the Commission may, by simple request or decision, require undertakings or associations of undertakings to provide all necessary information, notably on issues covered by Articles 4,7 and 11 but subject to the strictest data protection requirements applicable in the relevant Member State(s).

3. Without prejudice to paragraph 2 of this Article, the Commission may require undertakings and associations of undertakings which produce documents or statements pursuant to Regulation (EC) No 1/2003 to identify the documents or parts of documents which they consider to contain business secrets or other confidential information belonging to them and to identify the undertakings with regard to which such documents are to be considered confidential.
3. 3. Where the Commission requires undertakings and associations of undertakings to supply information by decision, it shall state the legal basis and the purpose of the request, specify what information is required and fix the time-limit within which it is to be provided.

Reiterates its call to the effect that the granting of Community and national aid to undertakings should help achieve the aims of the long-term safeguarding of jobs in recipient undertakings and of promoting regional development and calls for it to be made possible to require undertakings to repay such aid if they do not fulfil the associated conditions;
