By its appeal, the French Republic seeks to have set aside the judgment of the Court of First Instance of the European Communities of 4 December 2008 in Case T‑284/08 People’s Mojahedin Organisation of Iran v Council [2008] ECR I‑3487 (‘the judgment under appeal’), by which that court upheld the action brought by the People’s Mojahedin Organization of Iran (‘the PMOI’) for annulment of Council Decision 2008/583/EC of 15 July 2008 implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2007/868/EC (OJ 2008 L 188, p. 21, ‘the contested decision’), insofar as it concerned the PMOI.
Par son pourvoi, la République française demande l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 4 décembre 2008, People’s Mojahedin Organization of Iran/Conseil (T‑284/08, Rec. p. Points out that the organ shortage is linked in two ways to organ trafficking and trafficking in persons for the purpose of the removal of organs: firstly, increased organ availability in the Member States would contribute to better monitoring of these practices, by obviating any need for EU citizens to consider seeking an organ outside the EU, and, secondly, illegal activity seriously undermines the credibility of the legal organ donation system;

Urges the Member States, where necessary, to amend their criminal codes to ensure that those responsible for organ trafficking are adequately prosecuted, including sanctions for medical staff involved in transplantation of organs obtained from trafficking, while making every effort to discourage potential recipients from seeking trafficked organs and tissues; stresses that that consideration should be given to making EU citizens criminally liable for purchasing organs inside or outside the EU;

Where the competent organ decides not to act in accordance with the opinion expressed by the representative body, this body shall have the right to a further meeting with the competent organ of the SCE with a view to seeking agreement.

These special investigation methods should also only be used in a limited context and be subject to strict legal and parliamentary controls, including in particular effective preventive measures against misuse.
