As regards Regulation (EC) No 1774/2002, the Commission should be empowered in particular to establish rules on the disposal, processing, importation/exportation and transformation of Category 1, 2 and 3 material of animal by-products, as well as rules on the placing on the market of animal by-products coming from territories subject to animal health restrictions and of organic fertilisers and soil improvers; to define the conditions for the importation from third countries of petfood and raw material for petfood production; and to define specific or alternative hygiene requirements laid down in the Annexes.

1. Notwithstanding Article 3 and subject to compliance with the disease control measures referred to in Annex I, Member States may authorise the production, processing and distribution of products of animal origin which come from a territory or part of a territory subject to animal health restrictions but which do not come from a holding which is infected or suspected of being infected, provided that:
1. Nonobstant l'article 3 et dans le respect des mesures de lutte contre les maladies visées à l'annexe I, les États membres peuvent autoriser la production, la transformation et la distribution de produits d'origine animale provenant d'un territoire ou d'une portion de territoire soumis à des restrictions de police sanitaire, mais non d'une exploitation infectée ou suspectée d'être infectée, est autorisée, pourvu que:

(i) the first subparagraph is replaced by the following: "Where a consignment coming from a third country is assigned to customs warehousing or inward processing in the form of a system of suspension as foreseen in Council Regulation (EEC) No 2913/92 establishing the Community Customs Code(7), and subject to one or more preparations as defined in Article 4(3) of Regulation (EEC) No 2092/91, the consignment must be subject, before the first preparation is carried out, to the measures referred to in Article 4(1) of the present Regulation".
