seeks a flat-rate fee of EUR 1 750 per day for use of the playing surface, the changing rooms, the bar and the caretaking, surveillance and monitoring service for the facilities as a whole, it being understood that it has been agreed between the parties that, of the amount sought, 20% represents the right of access to the football pitch and 80% the consideration for various services connected with the maintenance, cleaning, upkeep (mowing, sowing, and so on) and regulatory compliance of the playing surface and ancillary services supplied by the party granting the right of use and exploitation (namely, RCA, the present appellant)?
réclame une indemnisation forfaitaire de 1.750 EUR par jour d’utilisation de la surface de jeu, des vestiaires, de l’utilisation de la buvette, du service de conciergerie, de surveillance et de contrôle de l’ensemble des installations, étant entendu que le montant réclamé représente conventionnellement le droit d’accéder au terrain de football jusqu’à concurrence de 20 % et, à hauteur de 80 %, la contrepartie de différents services de maintenance, de nettoyage, d’entretien (tonte, ensemensage, etc,...) et de mise aux normes de la surface de jeu et prestations de services accessoires, fournis par le concédant du droit d’utilisation et d’exploitation (en l’espèce, la Régie actuellement appelante).
