3. Member States shall not require disclosure for small undertakings beyond what is required or permitted by this Article.

The four conditions are: (a) the beneficiary of a State funding mechanism for an SGEI must be formally entrusted with the provision and discharge of an SGEI, the obligations of which must be clearly defined; (b) the parameters for calculating the compensation must be established beforehand in an objective and transparent manner, to avoid it conferring an economic advantage which may favour the recipient undertaking over competing undertakings; (c) the compensation cannot exceed what is necessary to cover all or part of the costs incurred in the discharge of the SGEI, taking into account the relevant receipts and a reasonable profit for discharging those obligations; and (d) where the beneficiary is not chosen pursuant to a public procurement procedure, the level of compensation granted must be determined on the basis of an analysis of the costs which a typical undertaking, well run, would have incurred in discharging those obligations, taking into account the relevant receipts and a reasonable profit.

Similarly, the Commission could not see why the smooth operation of the rendering service required the payment of what was possibly operating aid to undertakings not subject to the levy or payments to rendering undertakings that were possibly above what was necessary to cover the net cost of providing the rendering service.

When sending a simple request for information to a person, an undertaking or an association of undertakings, the Commission shall state the legal basis and the purpose of the request, specify what information is required and fix the time limit within which the information is to be provided, as well as the penalties provided for in Article 14 for supplying incorrect or misleading information.

At the request of an undertaking, national regulatory authorities shall, within one week, issue standardised declarations, confirming, where applicable, that the undertaking has submitted a notification under Article 3(2) and detailing under what circumstances any undertaking providing electronic communications networks or services under the general authorisation has the right to apply for rights to install facilities, negotiate interconnection, and/or obtain access or interconnection in order to facilitate the exercise of those rights for instance at other levels of government or in relation to other undertakings.

Whereas under Decision No 24-63 undertakings in the Community steel industry are required to make written returns to the High Authority of all transactions involving rebates or special prices for indirect export to steel processing undertakings in the Community which export all or part of their production to countries outside the Community ; whereas from these returns it should be possible to ascertain whether and to what extent such rebates or special prices are compatible with the prohibition of discrimination under Article 60 of the Treaty and what publication rules apply ; whereas Decision No 24-63 is due to expire on 31 December 1964;

Whereas the membership of an association may change without the High Authority's knowledge and whereas notification must be effective as notification to all undertakings which are members of the association at the date of adoption of the decision without it being necessary to enumerate them ; whereas undertakings are able to require the association to communicate the High Authority's decisions to them ; whereas it is necessary that the High Authority should know at all times what undertakings are members of an association;
