It cannot be excluded that the average consumer, who is accustomed to seeing various products from different undertakings packaged in the same type of packaging, does not at first identify the use of that type of packaging by an undertaking for the marketing of a given product as being, of itself, an indication of origin, when the same product is marketed by competitors of that undertaking in other types of packaging.
34 En effet, il ne saurait être exclu que le consommateur moyen, qui est habitué à voir divers produits provenant d’entreprises distinctes conditionnés dans un même type d’emballage, n’identifie pas d’emblée l’utilisation de ce type d’emballage par une entreprise pour la commercialisation d’un produit donné comme étant, en soi, une indication d’origine, quand bien même ledit produit est commercialisé par les concurrents de cette entreprise dans d’autres modes de conditionnement.
