The additional specific conditions for bluefin tuna caught in the eastern Atlantic by baitboats and trolling boats, for bluefin tuna caught in the Adriatic for farming purposes and for bluefin tuna caught in the Mediterranean by the coastal artisanal fishery for fresh fish by baitboats, longliners and handliners are set out in Annex I.
11. In bijlage I zijn de aanvullende specifieke voorwaarden vastgesteld voor blauwvintonijn die in het oostelijke deel van de Atlantische Oceaan wordt gevangen door met de hengel vissende vaartuigen en sleepvaartuigen, die in de Adriatische Zee voor kweekdoeleinden wordt gevangen, en die in de Middellandse Zee door met de hengel, de beug en de handlijn vissende vaartuigen wordt gevangen in het kader van de ambachtelijke kustvisserij op verse vis.

As in practice by-catch of yellowfin tuna is possible in other fisheries not targeting yellowfin tuna that are subject to the landing obligation, Article 3 of the Delegated Regulation (EU) 2015/98 should be amended to cover yellowfin tuna in addition to bigeye tuna.
Aangezien in de praktijk bijvangsten van geelvintonijn mogelijk zijn in andere visserijen die niet gericht op geelvintonijn vissen en die onderworpen zijn aan de aanlandingsverplichting, moet artikel 3 van Gedelegeerde Verordening (EU) 2015/98 worden gewijzigd zodat daaronder naast grootoogtonijn ook geelvintonijn valt.

Paragraph 4 of Recommendation 14-01 of the International Commission for the Conservation of Atlantic Tunas (‘ICCAT’) on a multi-annual conservation and management programme for tropical tunas states that fishing vessels 20 metres length overall or greater not entered into the ICCAT record of authorised tropical tuna vessels are deemed not to be authorised to fish, retain on board, tranship, transport, transfer, process or land bigeye and/or yellowfin tunas from the ICCAT Convention area.
In punt 4 van aanbeveling 14-01 van de Internationale Commissie voor de instandhouding van Atlantische tonijnen („ICCAT”) inzake een meerjarig programma voor de instandhouding en het beheer van tropische tonijnen is bepaald dat vissersvaartuigen met een lengte over alles van 20 meter of meer die niet zijn opgenomen in het ICCAT-register van vaartuigen die op tropische tonijnen mogen vissen, worden beschouwd als niet gemachtigd om grootoog- en/of geelvintonijnen uit het ICCAT-verdragsgebied te bevissen, aan boord te houden, over te laden, te vervoeren, over te brengen, te verwerken of aan te landen.

In addition to the automatic derogation referred to before, Mauritius has requested a derogation covering a quantity of 6 000 tonnes of preserved tuna of CN codes 1604 14 11, 1604 14 18 and 1604 20 70 manufactured from tuna of the species Katsuwonus pelamis (skipjack), Thunnus alalunga (albacore tuna), Thunnus albacares (yellow fin tuna) and Thunnus obesus (big eye tuna) imported into the Union from 1 April 2013 to 31 December 2013 in accordance with Article 42(1) of Protocol 1 to the interim EPA.
Naast de hiervoor bedoelde automatische afwijking heeft Mauritius een afwijking aangevraagd voor een hoeveelheid van 6 000 ton tonijnconserven van de GN-codes 1604 14 11, 1604 14 18 en 1604 20 70 vervaardigd van tonijn van het geslacht Katsuwonus pelamis (boniet), Thunnus alalunga (witte tonijn), Thunnus albacares (geelvintonijn) en Thunnus obesus (grootoogtonijn), bestemd voor invoer in de Unie van 1 april 2013 tot en met 31 december 2013 overeenkomstig artikel 42, lid 1, van Protocol nr. 1 bij de tussentijdse EPO.

In the interest of clarity, it is appropriate to set out explicitly that the only non-originating materials to be used for the manufacture of preserved tuna and tuna loins of CN code 1604 14 16 should be tuna of HS Headings 0302 or 0303, in order for the preserved tuna and tuna loins to benefit from the derogation.
Duidelijkheidshalve zij expliciet vermeld dat het enige niet van oorsprong zijnde materiaal voor de productie van tonijnconserven en tonijnfilets („loins”) van GN-code 1604 14 16 tonijn van de GS-posten 0302 of 0303 moet zijn om de tonijnconserven en tonijnfilets („loins”) voor de afwijking in aanmerking te laten komen.

Having regard to paragraphs 5 and 8 of Article 5 and paragraph 4 of Article 6 of Council Regulation (EC) No 302/2009 of 6 April 2009 concerning a multiannual recovery plan for bluefin tuna in the eastern Atlantic and Mediterranean (3) it is necessary to establish the maximum number and total capacity in gross tonnage of fishing vessels of each Member State that may be authorised to fish for, retain on board, tranship, transport, or land bluefin tuna, the maximum number of tuna traps that may be authorised by each Member State, the maximum tuna farming and fattening capacity for each Member State and the maximum input of wild caught bluefin tuna that each Member State may allocate to its farms.
Gelet op artikel 5, leden 5 en 8, en artikel 6, lid 4, van Verordening (EG) nr. 302/2009 van de Raad van 6 april 2009 betreffende een meerjarig herstelplan voor blauwvintonijn in het oostelijke deel van de Atlantische Oceaan en de Middellandse Zee (3) moeten het maximumaantal vissersvaartuigen van elke lidstaat die blauwvintonijn mogen bevissen, aan boord houden, overladen, vervoeren of aanlanden en hun totale capaciteit in brutoton worden vastgesteld, alsmede het maximumaantal tonijntonnara’s dat door elke lidstaat mag worden toegestaan, de maximumcapaciteit voor het kweken en mesten van tonijn voor elke lidstaat, en de maximumhoeveelheid in het wild gevangen blauwvintonijn die elke lidstaat over zijn kweek- en mestbedrijven mag verdelen.

(2) The ICCAT Convention provides a framework for regional cooperation in the conservation and management of tuna stocks and tuna-like species in the Atlantic Ocean and adjacent seas through the establishment of an International Commission for the Conservation of Atlantic Tunas, hereinafter called the "ICCAT", and the adoption by the latter of conservation measures which become binding on the contracting parties.
(2) Bij het ICCAT-verdrag wordt een kader vastgesteld voor de regionale samenwerking op het gebied van de instandhouding en het beheer van de bestanden van tonijnachtigen en verwante soorten in de Atlantische Oceaan en de aangrenzende zeeën, door de instelling van een Internationale Commissie voor de instandhouding van tonijnachtigen in de Atlantische Oceaan, hierna "de ICCAT" genoemd, en door de vaststelling van aanbevelingen voor de instandhouding en het beheer in het verdragsgebied, die voor de verdragsluitende partijen bindend worden.

8. Notwithstanding paragraphs 1 to 7, derogations concerning canned tuna and tuna loins shall only be granted within an annual quota of 8000 tonnes for canned tuna and within an annual quota of 2000 tonnes for tuna loins.
8. Onverminderd de leden 1 tot en met 7 worden afwijkingen voor tonijnconserven slechts toegestaan binnen een contingent van 8000 ton per jaar en voor tonijnzijden ("loins") binnen een contingent van 2000 ton per jaar.
