5. estime que plusieurs erreurs résultant d'infractions aux règles de passation des marchés publics et de la non-admissibilité de participants pourraient être dues aux conditions supplémentaires prévues par la législation nationale; demande à la Commission et aux États membres de contrôler ces cas de surréglementation active ou passive, afin de réduire la charge administrative inutile ainsi que la complexité de l'accès au FSE et à d'autres ressources en matière d'emploi et d'affaires sociales; attire l'attention, à cet égard, sur le rapport récent de la Commission intitulé "Simplification and Gold-plating in the European Social Fund" (Simplification et surréglementation dans le cadre du Fonds social européen), notamment dans le cadre de la mise en œuvre du nouveau règlement;
5. is van mening dat meerdere fouten die voortvloeien uit de niet-naleving van de regels voor overheidsopdrachten en niet in aanmerking komende deelnemers toe te schrijven zijn aan de bijkomende eisen van de nationale wetgeving; verzoekt de Commissie en de lidstaten dergelijke gevallen van actieve en passieve overregulering te herzien om onnodige administratieve lasten en complexe procedures voor toegang tot het ESF en andere middelen op het gebied van werkgelegenheid en sociale zaken te verminderen; vestigt hierbij de aandacht op het recente verslag van de Commissie met als titel "Simplification and Gold-plating in the European Social Fund", met name bij de uitvoering van de nieuwe verordening;
