IN-CONTEXT TRANSLATIONS

„ernstige inbreuk op de communautaire wetgeving inzake vervoer over de weg”: een inbreuk die ertoe kan leiden dat de vervoerder niet langer als betrouwbaar wordt beschouwd, overeenkomstig artikel 6, leden 1 en 2, van Verordening (EG) nr. 1071/2009, en/of dat de communautaire vergunning tijdelijk of definitief wordt ingetrokken.
‘serious infringement of Community road transport legislation’ means an infringement which may lead to the loss of good repute in accordance with Article 6(1) and (2) of Regulation (EC) No 1071/2009, and/or to the temporary or permanent withdrawal of a Community licence.

1. In geval van een ernstige inbreuk op de communautaire wetgeving inzake wegvervoer die in een lidstaat wordt gepleegd of geconstateerd, met name wat betreft de normen voor de voertuigen, de rij- en rusttijden van de bestuurders en het zonder vergunning verrichten van parallel of tijdelijk vervoer als bedoeld in artikel 5, lid 1, vijfde alinea, nemen de bevoegde instanties van de lidstaat waar de vervoerder die de inbreuk heeft gepleegd, is gevestigd, passende maatregelen, zoals bijvoorbeeld het geven van een waarschuwing, als de nationale wetgeving daarin voorziet.
1. In the event of a serious infringement of Community road transport legislation committed or ascertained in any Member State, in particular with regard to the rules applicable to vehicles, driving and rest periods for drivers and the provision without authorisation of parallel or temporary services, as referred to in the fifth subparagraph of Article 5(1), the competent authorities of the Member State of establishment of the carrier who committed the infringement shall take appropriate action, which may include a warning if provided for by national law, to pursue the matter.

Deze richtlijn maakt in geen enkel opzicht inbreuk op het beschermingsniveau van natuurlijke personen in verband met de verwerking van persoonsgegevens als gewaarborgd door het communautaire recht en het nationale recht, en wijzigt met name in geen enkel opzicht de verplichtingen die de lidstaten inzake de door hen uitgevoerde verwerking van persoonsgegevens bij Richtlijn 95/46/EG zijn opgelegd, noch de verplichtingen die de communautaire instellingen en organen zijn opgelegd bij Verordening (EG) nr. 45/2001 in verband met de verwerking van persoonsgegevens tijdens de uitoefening van hun taken.
This Directive is without prejudice to, and in no way affects, the level of protection of individuals with regard to the processing of personal data under the provisions of Community and national law and, in particular, does not alter Member States' obligations with regard to the processing of personal data, as laid down by Directive 95/46/EC, or the obligations incumbent upon Community institutions and bodies under Regulation (EC) No 45/2001 with regard to the processing of personal data by them in the course of their duties.

Onverminderd de middelen die in de communautaire of nationale wetgeving zijn of kunnen worden vastgelegd, voorzover deze middelen gunstiger zijn voor de rechthebbenden, zijn de bij deze richtlijn vastgestelde maatregelen, procedures en rechtsmiddelen overeenkomstig artikel 3 van toepassing op elke inbreuk op intellectuele-eigendomsrechten, zoals bepaald in het communautaire recht en/of het nationale recht van de betrokken lidstaat.

Without prejudice to the means which are or may be provided for in Community or national legislation, in so far as those means may be more favourable for rightholders, the measures, procedures and remedies provided for by this Directive shall apply, in accordance with Article 3, to any infringement of intellectual property rights as provided for by Community law and/or by the national law of the Member State concerned.

Richtlijn 2004/48/EG van het Europees Parlement en de Raad van 29 april 2004 betreffende de handhaving van intellectuele-eigendomsrechten bepaalt in artikel 2, lid 1, dat de richtlijn van toepassing is op elke inbreuk op intellectuele-eigendomsrechten, zoals bepaald in het communautaire recht en/of het nationale recht van de betrokken lidstaat.

Consequently, it is the right of parties subject to Community law that national courts should take provisional measures, that an effective end should be brought, by injunction, to the infringement of Community competition rules of which they are victims, and that compensation should be awarded for the damage suffered as a result of infringements, where such remedies are available in proceedings relating to similar national law.
