Niettegenstaande de horizontale aanpassing in het tweede streepje van de bijlage bij de Overeenkomst tussen de Europese Gemeenschappen en de Zwitserse Bondsstaat inzake luchtvervoer, zijn de verwijzingen naar de „lidstaten” in artikel 65 van de verordening of in de in dat artikel vermelde bepalingen van Besluit 1999/468/EG, niet van toepassing op Zwitserland.
Notwithstanding the horizontal adaptation provided for in the second indent of the Annex to the Agreement between the European Community and the Swiss Confederation on Air Transport, the references to the ‘Member States’ made in Article 65 of the Regulation or in the provisions of Decision 1999/468/EC mentioned in that provision shall not be understood to apply to Switzerland.

In de alinea's 3, 4, 6, 8, 10, 11, 13 en 14 wordt de datum „28 september 2003” vervangen door „de datum van inwerkingtreding van het besluit van het Comité luchtvervoer Gemeenschap/Zwitserland waarbij Verordening (EG) nr. 216/2008 wordt opgenomen in de bijlage bij de verordening”.
In paragraphs 3, 4, 6, 8, 10, 11, 13 and 14, the date ‘28 September 2003’ shall be replaced by ‘the date of entry into force of the Decision of the Community/Switzerland Air Transport Committee which incorporates Regulation (EC) No 216/2008 into the Annex to the Regulation’.

(2) Op 28 mei 1999 is in Montreal een nieuw Verdrag tot het brengen van eenheid in enige bepalingen inzake het internationale luchtvervoer vastgesteld, waarin nieuwe mondiale aansprakelijkheidsregels in geval van ongevallen voor het internationale luchtvervoer zijn opgenomen die de regels van het Verdrag van Warschau van 1929 en latere wijzigingen vervangen(4).
(2) A new Convention for the Unification of Certain Rules Relating to International Carriage by Air was agreed at Montreal on 28 May 1999 setting new global rules on liability in the event of accidents for international air transport replacing those in the Warsaw Convention of 1929 and its subsequent amendments(4).
