TRADUCTIONS EN CONTEXTE

Uit punt 1 van de eerste groep van toelatingsvoorwaarden in de kennisgeving van vacature blijkt immers dat, overeenkomstig artikel 98 van het Statuut, de kandidaten ofwel ambtenaar moesten zijn van het secretariaat-generaal van de Raad van de Europese Unie, ofwel ambtenaar van de Commissie of de EDEO, ofwel tijdelijk personeelslid waarop artikel 2, onder e), RAP van toepassing is, te weten lid van het personeel dat vanuit de nationale diplomatieke dienst van een van de lidstaten wordt aangesteld om tijdelijk een vast ambt bij de EDEO te vervullen, ofwel een lid van het personeel van de nationale diplomatieke dienst van een van de lidstaten.
It is clear from paragraph 1 of the first group of eligibility criteria contained in the vacancy notice that, according to Article 98 of the Staff Regulations, candidates must be officials of the General Secretariat of the Council of the European Union, of the Commission or of the EEAS, or temporary staff to whom Article 2(e) of the CEOS applies, that is to say, staff seconded from the national diplomatic services of the Member States engaged in order to occupy temporarily a permanent post within the EEAS, or staff from the national diplomatic services of the Member States.

It follows that, in view of the level of higher education required by the vacancy notice in the case of candidates who are staff from the national diplomatic services of the Member States, namely that provided for in Article 5(3)(b)(i) of the Staff Regulations for appointment to grades 5 and 6 in function group AD, and the number of years’ minimum professional experience required, which was only two, candidates who were staff from the national diplomatic services of the Member States, which included the applicant, could not be misled with regard to the grade that corresponded to the vacant post.

Het Gerecht constateert, in de eerste plaats, dat verzoekers bewering dat de kennisgeving van vacature enkel voor kandidaten die lid waren van het personeel van de nationale diplomatieke dienst van een van de lidstaten voorzag in een indeling in rang AD 5, berust op een onjuiste lezing van de tekst van die kennisgeving.
The Tribunal notes, first, that the applicant’s assertion that the vacancy notice provided for appointment to grade AD 5 only in the case of candidates from the diplomatic services of the Member States is based on a misreading of the wording of the vacancy notice.

Met de amendementen in dit advies worden drie belangrijke doelstellingen nagestreefd: (i) totstandbrenging van een operationeel kader waarmee kan worden ingestaan voor de volledige onafhankelijkheid en loyaliteit van de EDEO-personeelsleden bij het vervullen van hun taken, met name waar het gaat om van nationale diplomatieke diensten afkomstige personeelsleden, daar het niet de bedoeling is dat zij met "twee petten" op gaan functioneren, i.e. verantwoording afleggen aan zowel de hoge vertegenwoordiger als aan de hiërarchie van hun nationale diplomatieke dienst; zij moeten daarentegen uitsluitend functioneren onder het gezag en de verantwoordelijkheid van de hoge vertegenwoordiger in zijn hoedanigheid van het tot aanstelling bevoegde gezag; (ii) de hoge vertegenwoordiger - die overeenkomstig artikel 6, lid 12, van het besluit van de Raad tot vaststelling van de inrichting en werking van de Europese dienst voor extern optreden verantwoordelijk is voor het vaststellen van passende maatregelen voor een adequate gezamenlijke opleiding, waarbij met name wordt uitgegaan van bestaande nationale en EU-praktijken en -structuren binnen een jaar na de inwerkingtreding van dit besluit - voorstellen doen voor een uitermate hoogwaardig systeem van beroepsopleiding en bijscholing ten einde een echte esprit de corps onder het personeel van de EDEO tot stand te brengen waarin de noordelijke, oostelijke en zuidelijke universitaire en onderzoeksdimensie van de EU tot uiting komt; en (iii) een passend geografisch en genderevenwicht in de samenstelling van het EDEO-personeel waarborgen.
The amendments contained in this opinion pursue three important objectives: (i) providing an operational framework, which can ensure the full independence and loyalty of EEAS staff in the fulfilment of their tasks, in particular as far as staff coming from national diplomatic services are concerned, as they should not be "double-hatted", i.e., respond to both the High Representative and the hierarchy of their national diplomatic service of origin, but they should function solely under the instructions and responsibility of the High Representative, as their appointing authority; (ii) signifying to the High Representative - who, in accordance with Article 6(12) of the Council Decision establishing the EEAS bears the competence to take appropriate measures to provide EEAS staff with adequate common training, building in particular on existing national and EU practices and structures within the year following the entry into force of such Decision - a highly valuable system of training and professional development aimed at creating a true esprit de corps amongst EEAS staff and bringing to bear the northern, eastern and southern academic and research dimensions of the EU; and (iii) ensuring adequate geographical representativity and gender balance in the composition of EEAS staff.

To ensure an independent EEAS, staff coming from the national diplomatic services and serving in the EEAS should not have to respond to the human resources of their national diplomatic service of origin by means of annual evaluations or staff reports.
