TRADUCTIONS EN CONTEXTE

De toepassing van deze verordening laat de rechten en plichten van de lidstaten met betrekking tot de volle zee, overeenkomstig artikel 12 van het Verdrag van Chicago, en met name bijlage 2 bij het Verdrag van Chicago, onverlet, alsook de plichten van de lidstaten en de Unie uit hoofde van het Verdrag van de Verenigde Naties inzake het recht van de zee en de plichten van de lidstaten uit hoofde van het uit 1972 daterende Verdrag inzake de internationale bepalingen ter voorkoming van aanvaringen op zee.
The application of this Regulation should be without prejudice to the Member States’ obligations and rights over the high seas, in accordance with Article 12 of the Chicago Convention, and in particular with Annex 2 to the Chicago Convention, as well as the obligations of Member States and the Union under the United Nations Convention on the Law of the Sea and the obligations of Member States under the Convention on the International Regulations for Preventing Collisions at Sea, 1972.

As regards more particularly a decision reassigning an official, despite the fact that it does not constitute a report relating to his ability, efficiency or conduct within the meaning of Article 26, emails or a note signed by officials and other staff criticising the attitude of the official in question must first be communicated to him and placed on his personal file, since they are capable of having a decisive influence on the decision whether or not to reassign him.

As regards the interest which an official or former official has in seeking annulment of a career development report concerning him, it must be observed that that report constitutes a value judgement made by his immediate superiors on the way in which the official has discharged the tasks entrusted to him and on his conduct in the service during the relevant period and that, independently of its utility in the future, it constitutes written and formal evidence of the quality of the official’s work.
