9. sluit zich aan bij de zorgen die veel plaatselijke autoriteiten hebben geuit met betrekking tot de interpretatie van de arresten van het Hof van Justitie op het gebied van stadsontwikkeling; is ervan overtuigd dat de in operationeel en juridisch opzicht strikte toepassing van regels inzake overheidsopdrachten de stadsontwikkeling in de weg kan staan; verzoekt de Commissie de desbetreffende regels inzake overheidsopdrachten in nauwe samenwerking met het Europees Parlement, de Raad en de regionale en plaatselijke overheden zo duidelijk te formuleren dat de publieke opdrachtgevers weten welke contracten en concessies voor openbare werkzaamheden moeten worden aanbesteed en dus een onderscheid kunnen maken tussen wel en niet aanbestedingsplichtige projecten op het gebied van stedenbouw en stadsontwikkeling, zodat er gemakkelijker contracten over de verkoop van land tussen de publieke en de particuliere sector kunnen worden gesloten, zonder de overbodige eis dat er een aanbesteding moet worden gedaan en zonder de bevoegdheid en het recht van plaatselijke autoriteiten om te beslissen hoe zij hun grondgebied willen inrichten, in gevaar te brengen; kijkt met grote belangstelling uit naar het arrest van het Hof van Justitie in zaak C-451/08; sluit zich aan bij het standpunt dat de advocaat-generaal van het Hof op 17 november 2009 in zaak C-541/08 heeft uitgesproken: "De ruime en ambitieuze doelstellingen van de richtlijn, die bij de uitlegging ervan weliswaar in het achterhoofd moeten worden gehouden, mogen met een beroep op het doel van die tekst evenwel niet tot de conclusie leiden dat de werkingssfeer ervan onbeperkt kan worden uitgebreid" (paragraaf 35); anders bestaat het gevaar "dat elke stedenbouwkundige activiteit onder de richtlijn valt: de maatregelen waarmee de bebouwingsmogelijkheid wordt geregeld, wijzigen immers per definitie en zelfs substantieel de waarde van de grond waarop zij betrekking hebben".
9. Endorses the concerns voiced by many local authorities in response to the interpretation of the rulings of the Court of Justice in the field of urban development; firmly believes that the operationally and legally strict application of public procurement rules might hinder urban development; calls on the Commission to draw up, in close cooperation with Parliament, the Council and regional and local authorities, the corresponding public procurement rules with sufficient clarity to enable contracting authorities clearly to identify which public works contracts and concessions are subject to the procurement rules and thus distinguish between such contracts and concessions and urban development projects which are not subject to those rules, so that land agreements can be facilitated between the public and private sector without the unnecessary requirement of having to issue a call for tenders and without jeopardising the powers and right of local authorities to decide how they want to develop their territory; awaits with great interest the judgment of the Court of Justice in Case C-451/08; endorses the view of the Advocate-General of the Court of Justice delivered on 17 November 2009 in Case C-451/08: ‘These broad and ambitious aims must be borne in mind when interpreting the Directive but it should not be assumed that, by appealing to the purpose of the measure, its scope can be extended indefinitely’ (paragraph 35); otherwise there is the risk ‘that all town planning activities are subject to the Directive since, by definition, provisions on the possible execution of building works substantially alter the value of the land in question’.

Where an undertaking providing electronic communications networks has the right under national legislation to install facilities on, over or under public or private property, or may take advantage of a procedure for the expropriation or use of property, national regulatory authorities shall encourage the sharing of such facilities or property, in particular where undertakings are deprived of access to viable alternatives because of the need to protect the environment, public health, public security or to meet town and country planning objectives.
