2. 2. Paragraph 1 shall not apply where the presence of a person is required for the fulfilment of a judicial process or exclusively for medical, safety or other humanitarian purposes, or the Sanctions Committee has determined on a case-by-case basis that the expulsion of a person would be contrary to the objectives of UNSCRs 1718 (2006), 1874 (2009), 2087 (2013), 2094 (2013) and 2270 (2016), or if the relevant Member State has determined on a case-by-case basis that the expulsion of a person would be contrary to the objectives of this Decision.

3. 3. Maatregelen uit hoofde van deze doelstelling zullen onder andere dienen ter ondersteuning van de menselijke waardigheid (in het bijzonder de strijd tegen de doodstraf, foltering en andere wrede, onmenselijke of onterende behandeling of bestraffing); economische, sociale en culturele rechten; strijd tegen straffeloosheid; strijd tegen elke vorm van discriminatie; rechten van de vrouw en gendergelijkheid.
Actions under this objective will, inter alia, support human dignity (in particular the fight against the death penalty and against torture and other cruel, inhuman or degrading punishment or treatment); economic, social and cultural rights; the fight against impunity; the fight against discrimination in all its forms; women's rights and gender equality.

12. is van mening dat de hoogte van de pretoetredingssteun ten behoeve van de hervorming van de rechtsstelsels en de strijd tegen corruptie geen afspiegeling vormt van de prioriteit die de Commissie in dit verband heeft vastgesteld; dringt er, gezien het belang van de met het rechtsstelsel en de corruptie verband houdende kwesties, de ernst van de problemen ter plaatse, alsmede de positieve overloopeffecten en synergieën die aan andere sectoren ten goede zouden komen, indien de hervormingen van het rechtsstelsel en de strijd tegen corruptie naar behoren worden afgesloten en uitgevoerd, bij de Commissie en de begunstigde landen op aan om beduidend meer en adequate middelen voor deze twee sectoren uit te trekken; merkt echter op dat andere factoren zoals landgebonden gestructureerde dialogen over de rechtsstaat en het rechtsstelsel een aanzienlijke impact hebben op de doeltreffendheid van de EU-pretoetredingssteun in het kader van de hervorming van het rechtsstelsel en de strijd tegen corruptie; ziet derhalve onder ogen dat het percentage van de totale financiering niet het enige criterium is voor de efficiëntie van de EU-inspanningen om de rechtsstaat en anti-corruptiepraktijken te versterken;
12. Is of the opinion that the level of pre-accession assistance invested in judiciary reform and the fight against corruption does not reflect the priority set by the Commission in this respect; given the importance of judiciary and corruption-related issues, the severity of the problems faced in the field, as well as the positive spillovers and synergies that other sectors would benefit from if judiciary and anti-corruptions reforms were duly completed and implemented, urges the Commission and the beneficiary countries to allocate a more substantial and adequate level of funding to these two sectors; notes nevertheless that other factors, such as country-specific structured dialogues on the rule of law and the judiciary, have a substantial impact on the efficiency of the EU pre-accession assistance in the reform of judicial systems and the fight against corruption; recognizes therefore that the share of overall financing is not the only criterion for the efficiency of the EU efforts to strengthen the rule of law and anti-corruption practices;

46. herinnert aan de oproep van het Parlement aan de Commissie om een beoordeling uit te voeren van de impact en de resultaten die zijn geboekt met de toewijzing van EU-fondsen voor de hervorming van het rechtsstelsel en de strijd tegen corruptie in kandidaat-landen en potentiële kandidaat-landen ; is ingenomen met de publicatie door de Commissie in 2012/2013 van de evaluatie over het rechtsstelsel en grondrechten in Turkije en de evaluatie over de rechtsstaat, de hervorming van het rechtsstelsel en de strijd tegen corruptie en georganiseerde misdaad op de Westelijke Balkan; betreurt het niettemin dat de evaluatie over Turkije geen beoordeling bevatte over de projecten in verband met de strijd tegen corruptie;

Recalls Parliament's call on the Commission to assess the impact and results achieved through the allocation of EU funds in the reform of the judiciary and the fight against corruption in candidate and potential candidate countries ; welcomes the publication by the Commission in 2012/2013 of an evaluation on Judiciary and Fundamental Rights in Turkey and an evaluation of Rule of Law, Judiciary Reform and Fight against Corruption and Organised Crime in the Western Balkans; regrets nevertheless that the evaluation on Turkey did not include a review of the projects related to the fight against corruption;

Notes that measures to fight terrorism have resulted in violations of basic human rights in a number of countries around the world, in the form of the application of disproportionate surveillance measures, illegal detentions and the use of torture as a means of extracting information from suspected terrorists; expresses concern that certain countries are using the fight against terrorism as a cloak to crack down on ethnic minorities and local human rights defenders, and urges that the fight against terrorism not be used as an argument to restrict or ban the lawful and legitimate action of human rights defenders; condemns these violations of human rights, underlines the EU's position that the fight against terrorism must be conducted with full respect for fundamental rights and the rule of law and is convinced that civil liberties should not be compromised in the fight against terrorism;

Considers that, while it is important that the Euro-Arab relationship include consideration of the need to combat terrorism, it is vital for the effectiveness and substance of that relationship that the fight against terrorism does not overshadow or hold back a host of other topics of common interest, such as economic and social development, employment, sustainable development, proper public administration, the fight against corruption, the development and consolidation of a strong and genuine civil society as the promoter of advances in terms of the democratic system and of tolerance, the fight for gender equality, conservation of the global cultural heritage, inter-cultural dialogue, good governance, free and fair media, political participation and the promotion of human rights and fundamental freedoms, freedom of conscience including religious freedom, freedom of expression and association, the rejection of torture and the abolition of the death penalty, and the rejection of intolerance and fundamentalism, with a view to creating a genuine area of shared peace and prosperity;

Justice and Home Affairs: It is important to improve border management, including short sea-crossings; cooperation between enforcement bodies and agencies; cooperation in the fight against organised crime and cross-border crime and in civil and commercial judicial matters; cooperation in the fight against illegal immigration, and management of legal migration and implementation of migration plans (for example with the three central Maghreb countries, Libya and Egypt); cooperation in the fight against drug trafficking, reduction of drug supply and implementation of national strategies against drugs; cooperation between neighbouring countries in the effective control of borders by specialised and trained personnel; judicial and police cooperation.
