Krachtens het Verdrag van Lissabon blijft de solidariteit tussen de lidstaten behouden en daarom hebben niet-vertegenwoordigde burgers in alledaagse gevallen van consulaire bescherming, zoals verloren identiteitsdocumenten, een arrestatie, hechtenis of sterfgeval het recht de hulp in te roepen van een diplomatieke of consulaire autoriteit van om het even welke lidstaat.
According to the Lisbon Treaty the solidarity among Member States shall be sustained, therefore in the everyday cases of consular protection, such as in case of lost identity documents, arrest, detention, or death, the unrepresented citizen has the right to request the help of any diplomatic or consular authority of any Member State.

Via de diplomatieke en consulaire vertegenwoordigingen moet het land van herkomst voor de burgers van de EU bescherming en hulp waarborgen (artikel 3 van het Verdrag van Wenen inzake diplomatiek verkeer en artikel 1 van het Verdrag van Wenen inzake consulair verkeer). EU citizens must have access to protection and assistance from their own countries, via their diplomatic missions and consulates (Article 3 of the Vienna Convention on Diplomatic Relations and Article 1 of the Vienna Convention on Consular Relations) and, under the provisions of the Maastricht Treaty, additional diplomatic and consular protection beyond the borders of the European Union, which stems from their status as EU citizens.

Before concluding such a contract, the diplomatic mission or consular post of the Member State concerned shall justify, with reasons in accordance with Point VII, point 1.B, the need for the contract with the diplomatic missions and consular posts of other Member States and the Commission delegation within local consular cooperation.
