De Europese Commissie heeft vandaag beslist Polen voor het Hof van Justitie van de EU te dagen omdat het land geen kennis heeft gegeven van de volledige omzetting in nationaal recht (gedeeltelijke niet-omzetting) van de EU-regels betreffende het collectieve beheer van auteursrechten en naburige rechten en de multiterritoriale licentieverlening van rechten inzake muziekwerken voor het online gebruik ervan (Richtlijn 2014/26/EU).
The European Commission decided today to refer Poland to the Court of Justice of the EU for failure to notify complete transposition (partial non-transposition) of EU rules on collective management of copyright and related rights, and multi-territorial licensing of rights in musical works for online use (Directive 2014/26/EU) into national law.

De huidige Europese wettelijke bepalingen inzake betalingen zijn neergelegd in verschillende soorten EU-rechtsinstrumenten: Verordening nr. 2560/2001/EG, die bepaalt dat de kosten voor grensoverschrijdende betalingen in euro binnen de EU gelijk moeten zijn aan die voor soortgelijke binnenlandse betalingen en die rechtstreeks bindend is zonder omzetting in nationaal recht; richtlijn 97/5/EG [11], die grensoverschrijdende overmakingen vergemakkelijkt door cliënten een bepaalde bescherming te bieden en die eerst kan worden toegepast na de omzetting ervan in nationaal recht; aanbeveling 97/489/EG [12], die voorziet in de bescherming van cliënten die elektronische betaalinstrumenten, zoals betaalkaarten, gebruiken en die - hoewel geen juridisch bindend instrument - werd geacht volledig te worden uitgevoerd en toegepast in de EU. The present EU legal provisions on payments are contained in different types of EU legal instruments: a Regulation (2560/2001/EC) introducing the equality of charges for cross-border intra-EU payments in euro and corresponding national payments, which is directly legally binding without transposition into national law; a Directive (97/5/EC) [11] facilitating cross-border credit transfers in establishing some customers' protection requirements, which had to be transposed into national law to become applicable; a Recommendation (97/489/EC) [12] providing for the protection of customers using electronic payment instruments, such as payment cards, which - although not a legally binding instrument - was supposed to be fully implemented and applied in the EU. The co-existence of the three key legal acts is confusing [13] since several provisions overlap.

Must Clause 8(2) of the ‘revised Framework Agreement on Parental Leave’ (Directive 2010/18), and, more specifically, the provision in accordance with which ‘[i]mplementation of the provisions of this agreement shall not constitute valid grounds for reducing the general level of protection afforded to workers in the field covered by this agreement’, be interpreted as meaning that, should a Member State fail to implement Directive 2010/18 expressly, the scope of the protection which that State itself defined in transposing the earlier Directive 96/34 (2) may not be reduced?

De Commissie zal, samen met de nationale regelgevende instanties, de noodzaak tot herziening van onderhavige aanbeveling evalueren, na de datum voor de omzetting in nationaal recht die bepaald werd in het herziene regelgevingskader.
