4.1 The EESC believes that the law applicable to married couples should be determined when the marriage is contracted in order to avoid a choice of law that has no legal connection with the marriage. Where existing marriages are concerned, in the absence of a choice, a list of objective criteria could be drawn up to determine applicable law, in accordance with the system adopted in the recent Rome III Regulation (8).
4.1 Le CESE juge souhaitable que le choix de la règlementation applicable aux couples mariés s'effectue au moment du mariage même, en évitant que puisse être choisie une loi à laquelle le mariage ne puisse être rattaché du point de vue législatif, et en prévoyant au contraire pour les mariages préexistants, si aucun choix n'est arrêté, une liste de critères de rattachement objectifs, afin d'identifier la loi devant être appliquée, conformément au système adopté dans le règlement récent «Rome III» (8).
