As a preliminary remark the Commission points out that state aid to PZL Dębica may have been awarded by virtue of the failure to enforce in full PZL Dębica’s public debt to the Social Security Office (23).

Poland provided a letter dated 20 November 2006 in which the Social Security Office informed the company of its intention to file for PZL Dębica’s bankruptcy. In reply, on 12 December 2006, PZL Dębica provided the Social Security Office with details of the first restructuring plan, its financial situation and future prospects, indicating inter alia that in 2006 the company would record a profit for the first time.

PZL Hydral S.A. was until 2008 specialised in the production of civil and military aviation hydraulics and related services. This activity has been gradually taken over by its subsidiary, PZL Wroclaw S.A. In the framework of the restructuring plan, PZL Wroclaw, which has circa 550 employees, will be bought by a strategic investor who will carry out an investment plan of PLN 65 million (EUR 16 million) and integrate the company into its international operations.
