5. Welcomes the main initiatives taken by the Commission, at Parliament’s request, to shape a new EU legislative landscape for anti-fraud policy, and in particular the proposal for a directive on the fight against fraud to the Union’s financial interests by means of criminal law, which aims to clarify and harmonise Member States’ provisions in criminal law on offences related to the EU budget (COM(2012)0363), the proposal for a Council regulation on the establishment of the European Public Prosecutor’s Office (COM(2013)0534), and the proposal for a regulation on the European Union Agency for Criminal Justice Cooperation (Eurojust) (COM(2013)0535), as well as the amendment to Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and stronger legal rights for persons concerned by OLAF investigations; recognises the importance for these different pieces of legislation to be well calibrated and thoroughly evaluated; calls on the Council to take the necessary time and not to finalise negotiations in a rush, in order to develop a robust European legal framework and strengthen the existing institutional tools for protecting the Union’s financial interests; stresses that a premature transition to the enhanced cooperation procedure should be avoided; welcomes also the action plan to step up the fight against tax fraud and tax evasion, as well as VAT reform in the EU, both efforts having been initiated in 2011;
5. salue les principales initiatives menées par la Commission, à la demande du Parlement européen, en vue de la définition d'un nouveau paysage législatif européen en matière de politique anti-fraude et, en particulier, la proposition de directive relative à la lutte contre la fraude portant atteinte aux intérêts financiers de l'Union au moyen du droit pénal visant à clarifier et harmoniser le droit pénal des États membres concernant les infractions relatives au budget de l'UE (COM(2012)0363), la proposition de règlement du Conseil portant création du Parquet européen (COM(2013)0534) et la proposition de règlement relatif à l'Agence européenne de coopération judiciaire en matière pénale EUROJUST (COM (2013)0535) ainsi que la modification au règlement (CE) n° 1073/1999 relatif aux enquêtes de l'OLAF et au renforcement des droits procéduraux des personnes concernées par une enquête de l'OLAF; mesure l'importance de bien calibrer et d'évaluer soigneusement ces différents actes législatifs; demande au Conseil de prendre le temps nécessaire et de ne pas clore les négociations à la hâte, de manière à constituer un solide cadre juridique européen et à renforcer le volet institutionnel existant de la protection des intérêts financiers de l'Union; souligne qu'il convient de ne pas passer prématurément à la procédure de coopération renforcée; se félicite également du plan d'action destiné à renforcer la lutte contre la fraude et l'évasion fiscales, et la réforme du système de la TVA dans l'Union, toutes deux engagées en 2011;

The European Anti-Fraud Office (OLAF) may carry out investigations, including on-the-spot checks and inspections in accordance with the provisions and procedures laid down in Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by OLAF and Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the Union in connection with a grant agreement or grant decision or a contract concerning Union funding.
2 bis. L'Office européen de lutte antifraude (OLAF) peut mener des enquêtes, et notamment effectuer des contrôles et vérifications sur place selon les dispositions et modalités prévues par le règlement (CE) n° 1073/1999 du Parlement européen et du Conseil du 25 mai 1999 relatif aux enquêtes effectuées par l'OLAF et le règlement Euratom, CE) n° 2185/96 du Conseil du 11 novembre 1996 relatif aux contrôles et vérifications sur place effectués par la Commission pour la protection des intérêts financiers des Communautés européennes contre les fraudes et autres irrégularités en vue d'établir l'existence éventuelle d'une fraude, d'un acte de corruption ou de toute autre activité illégale portant atteinte aux intérêts financiers de l'Union, dans le cadre d'une convention de subvention, d'une décision de subvention ou d'un contrat concernant un financement de l'Union.

The European Anti- Fraud Office (OLAF) may carry out investigations, including on-the-spot checks and inspections, █ in accordance with the provisions and procedures laid down in Regulation (EU, Euratom) No 883/2013 of the European Parliament and of the Councilof 11 September 2013 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and Council Regulation (Euratom, EC) No 2185/ 96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities' financial interests against fraud and other irregularities with a view to establishing whether there has been fraud, corruption or any other illegal activity affecting the financial interests of the █ Union in connection with a grant agreement or grant decision or a contract █ funded under this Regulation .

Provision of any information concerning investigations conducted by the Office to the European Parliament, the Council, the Commission or the Court of Auditors, whether bilaterally or as part of an exchange of views, should respect the confidentiality of investigations, the legitimate rights of the persons concerned and, where applicable, the national provisions governing judicial proceedings.
La communication d’informations concernant les enquêtes menées par l’Office au Parlement européen, au Conseil, à la Commission et à la Cour des comptes, soit de manière bilatérale, soit dans le cadre de l’échange de vues, devrait s’effectuer dans le respect de la confidentialité des enquêtes, des droits légitimes des personnes concernées et, le cas échéant, des dispositions nationales applicables aux procédures judiciaires.

1. The amended proposal of the Commission for amending Regulation (EC) 1073/1999 concerning investigations conducted by OLAF focuses on strengthening the procedural rights of the persons concerned by OLAF investigations and on enhancing the efficiency of the OLAF's investigations, as well as on improving the cooperation with its partners (EU institutions and bodies, Member States, international organisations).

La proposition modifiée de la Commission modifiant le règlement (CE) n° 1073/1999 relatif aux enquêtes effectuées par l’OLAF s’attache à renforcer les droits procéduraux des personnes concernées par les enquêtes de l'OLAF et à accroître l’efficacité de ces enquêtes, ainsi qu'à améliorer la coopération avec ses partenaires (institutions et organes de l'Union, États membres, organisations internationales).

67. Welcomes the progress made in the negotiations on the proposal for a regulation of the European Parliament and of the Council amending Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and repealing Regulation (Euratom) No 1074/1999 (COM(2011)0135); considers that this regulation should be adopted as soon as possible; is, however, convinced that in the light of the latest developments surrounding OLAF and the way its investigations were conducted, the recommendations of the Supervisory Committee set out in Annex 3 to its 2012 Annual Activity Report should be taken into consideration; finds it unacceptable that the Supervisory Committee, being the body that oversees the application of the procedural guarantees, respect for fundamental rights, and compliance by the OLAF staff with the internal rules on investigative procedures, has in a number of cases not been granted direct access to case files in closed investigations including the final investigation reports transmitted to the national judicial authorities;
67. salue les progrès réalisés dans les négociations relatives à la proposition de règlement du Parlement européen et du Conseil modifiant le règlement (CE) n° 1073/1999 relatif aux enquêtes effectuées par l'Office européen de lutte antifraude (OLAF) et abrogeant le règlement (Euratom) n° 1074/1999 (COM(2011)0135); estime que ce règlement devrait être adopté dans les meilleurs délais; est néanmoins convaincu qu'à la lumière des derniers développements entourant l'OLAF et de la façon dont ses enquêtes sont menées, les recommandations du comité de surveillance figurant à l'annexe 3 de son rapport d'activité annuel pour 2012 doivent être prises en considération; juge inacceptable que le comité de surveillance, qui est l'organe qui supervise l'application des garanties de procédure, le respect des droits fondamentaux et le respect par le personnel de l'OLAF des règles internes sur les procédures d'enquête, n'ait pas pu accéder, dans un certain nombre de cas, à des dossiers appartenant à des enquêtes clôturées, y compris des rapports d'enquête finaux transmis aux autorités judiciaires nationales;

in the field of the investigation of marine casualties and incidents in accordance with Directive 2009/18/EC of the European Parliament and of the Council of 23 April 2009 establishing the fundamental principles governing the investigation of accidents in the maritime transport sector ; the Agency shall, if requested by the relevant Member States and assuming that no conflict of interest arises, provide operational support to these Member States concerning investigations related to serious or very serious casualties and it shall carry out analysis of safety investigation reports with a view to identify added value at Union level in terms of any relevant lessons to be drawn.
dans le domaine des enquêtes sur les accidents et incidents de mer en application de la directive 2009/18/CE du Parlement européen et du Conseil du 23 avril 2009 établissant les principes fondamentaux régissant les enquêtes sur les accidents dans le secteur des transports maritimes ; si les États membres concernés le demandent et en supposant qu'aucun conflit d'intérêts ne survienne, l'Agence prête une assistance opérationnelle à ces États membres concernant des enquêtes liées à des accidents graves ou très graves et elle analyse les rapports d'enquête de sécurité en vue de dégager une valeur ajoutée au niveau de l'Union en ce qui concerne tous les enseignements pertinents à en tirer.

(c)in the field of the investigation of marine casualties and incidents in accordance with Directive 2009/18/EC of the European Parliament and of the Council of 23 April 2009 establishing the fundamental principles governing the investigation of accidents in the maritime transport sector ; the Agency shall, if requested by the relevant Member States and assuming that no conflict of interest arises, provide operational support to these Member States concerning investigations related to serious or very serious casualties and it shall carry out analysis of safety investigation reports with a view to identify added value at Union level in terms of any relevant lessons to be drawn.

(e) it shall facilitate cooperation between the Member States and the Commission in the development, with due regard to the different legal systems in the Member States, of a common methodology for investigating maritime accidents according to agreed international principles, in the provision of the support of the Member States in activities concerning investigations related to serious maritime accidents, and in the carrying out of an analysis of existing accident investigation reports.
e) elle facilite la coopération entre les États membres et la Commission dans l'élaboration, compte dûment tenu des différents systèmes juridiques existant dans les États membres, d'une méthodologie commune pour enquêter sur les accidents maritimes répondant à des principes convenus au niveau international, en soutenant les États membres dans les activités relatives aux enquêtes portant sur des accidents maritimes graves, et en procédant à l'analyse des rapports d'enquête déjà établis sur les accidents.
