The EU Treaties guarantee all EU citizens the right to equal treatment regarding protection from the diplomatic and consular authorities of any EU country when they are travelling or living outside the EU and their own country is not represented (see Articles 20(2)(c) and 23 of the Treaty on the Functioning of the European UnionArticle 46 of the EU Charter of Fundamental Rights).

The Commission wishes to ensure that citizens are more fully informed about their rights as regards diplomatic and consular protection under Article 20 of the Treaty establishing the European Community (EC Treaty) and Article 46 of the European Union Charter of Fundamental Rights.

The Commission envisages the following action: in response to requests for actions against alleged violations of fundamental rights by Member States, to continue to monitor and promote fundamental rights in accordance with the EU Treaty and its 2002 Communication on Article 7 TUE; to give utmost priority to the correct implementation by Member States of the Council Directive 2004/38/EC on the right of free movement and residence within the EU; in recognition of the importance of developing a common EU knowledge and common standards on how to protect EU citizens who need help in a third country in which their homeland is not represented, the Commission is willing to contribute to training activities in favour of EU Member States officials; to continue with its information and communications campaign on EU citizens’ rights to diplomatic and consular EU protection and to consider how to develop further the creation of ‘Euro-Consulates’ to share common consular functions and to establish a European consular code.
La Commission envisage les actions suivantes: en réponse à des demandes d’intervention à la suite d'allégations de violation des droits fondamentaux par les États membres, elle continuera de veiller au respect de ces droits et d’en assurer la promotion conformément au traité sur l’Union européenne (traité UE) et à sa communication de 2002 sur l'article 7 du traité UE; elle accordera la priorité absolue à la mise en œuvre correcte par les États membres de la directive 2004/38/CE du Conseil relative au droit des citoyens de l'Union de circuler et de séjourner librement sur le territoire des États membres; parce qu'elle reconnaît l'importance de développer des connaissances et des normes communes au niveau de l’Union quant au mode de protection des citoyens européens qui requièrent une assistance sur le territoire d’un pays tiers où leur État d’origine n’est pas représenté, la Commission est disposée à contribuer aux activités de formation destinées aux fonctionnaires des États membres de l’UE; elle poursuivra ses campagnes d'information et de communication sur les droits des citoyens de l'UE à une protection diplomatique et consulaire et étudiera la manière de faire progresser la création d’«euro-consulats» afin de partager des fonctions consulaires communes et de définir un code consulaire européen.

When diplomatic immunity is extended to people who want to participate in a conference held in Canada, that goes way beyond the fundamental concept of diplomatic immunity, including extending that privilege to ambassadors, even though we may be at war and in a hostile environment where they can come and speak without fear of arrest while doing their jobs.
