The Dutch Media Commission, by decision of 5 February 2002, upheld its previous decision of 20 November 1997.

In this initial decision, it held that RTL/Veronica de Holland Media Group SA was the responsible broadcasting organisation for RTL 4 and RTL5, which therefore fell under the jurisdiction of the Dutch authorities.

F. whereas the protests on the Maidan started as pro-EU demonstrations but their focus later switched to more domestic issues – corruption, the economic crisis, distrust in politics and disillusionment with the political system of Ukraine; whereas on the other hand the Ukranian oligarchs, who opposed the policy of President Yanukovych, used these protests for their own interests; whereas Ukrainian oligarchs created, own and finance media holdings and NGOs, including Hromadske.tv, the Channel 5 television station and the NGO Centre UA, which was founded by Oleh Rybachuk and which strongly influenced the developments on the Maidan; whereas foreign actors, American tycoons – such as Soros and Omidyar – and foreign foundations, such as the National Endowment for Democracy, financed the protests; whereas foreign donations also came from state actors, including the Dutch embassy; whereas these facts show that the protests on the Maidan were not only an expression of citizens’ protest against state policies and the situation in the country;

(B) Whereas the Dutch authorities argue that the redundancies were caused by the global financial and economic crisis resulting in a global drop in demand for the graphic media industry; whereas as a consequence the turnover in the graphic industry decreased by 8,6 % in 2009 due to a reduced number of orders for printed advertising material and drops in demand for newspapers and magazines (by 25,7 % and 24,4% respectively) and, in parts of Noord-Brabant, the unemployment rate for graphic professions increased by 88% between October 2008 and October 2010;
(B) considérant que les autorités néerlandaises avancent que les licenciements ont été causés par la crise économique et financière mondiale, qui a entraîné une diminution substantielle de la demande dans le secteur des médias graphiques; considérant que, pour cette raison, le chiffre d'affaires de l'industrie des médias graphiques a chuté de 8,6 % en 2009 à cause du nombre limité de commandes de matériel publicitaire imprimé et de la baisse de la demande de journaux et de magazines (respectivement de 25,7 % et 24,4 %) et, dans certaines zones du Noord-Brabant, que le taux de chômage relevé dans les métiers du graphisme a augmenté de 88 % entre octobre 2008 et octobre 2010;

[41] The Commission initiated infringement proceedings against the Dutch authorities following the decision of the Dutch Media Commission (Commissariaat voor de media) to grant itself jurisdiction for the programmes RTL 4 and RTL 5 put out by a broadcaster falling under the jurisdiction of the Luxembourg authorities.
