The Court found that, as the applicant had not had full access to his records, which contained the principal sources of information regarding significant periods of his formative years, the respondent state should be condemned for failure to fulfil the positive obligation to protect the applicant’s private and family life in respect of his access to his records.
La Cour a estimé que le requérant n'ayant pu avoir plein accès à ses dossiers, qui constituaient la principale source d'information sur des périodes importantes des années de sa formation, il convenait de condamner l'État concerné puisqu'il avait failli à son obligation positive de protéger la vie privée et familiale du requérant quant à l'accès aux dossiers le concernant.
