Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. Where a market sounding involves the disclosure of inside information, the disclosing market participant will be considered to be acting within the normal course of his employment, profession or duties where, at the time of making the disclosure, he informs and receives the consent of the person to whom the disclosure is made that he may be given inside information; that he will be restricted by the provisions of this Regulation from trading or acting on that information; that reasonable steps must be taken to protect the ongoing confidentiality of the information; and that he must inform the disclosing market participant of the identities of all natural and legal persons to whom the information is disclosed in the course of developing a response to the market sounding.

(Return tabled) Question No. 286 Mr. Alex Atamanenko: With regard to the horse slaughter industry in Canada: (a) does the government know whether third party monitoring of video footage is occurring at Viandes Richelieu and Bouvry Exports and, if so, (i) what is the monitoring criteria, (ii) who is monitoring the footage, (iii) what actions, if any, have been taken as a result of observations, (iv) is footage monitoring to be a daily practice at this and other Canadian horse slaughter plants, (v) how many hours have been monitored, (vi) is footage archived and for how long, (vii) does the recording continuously loop over previous footage; (b) which tissue types and/or bodily fluids are targeted by the government when testing for phenylbutazone and other drugs in horsemeat, (i) what percentage of drug testing is performed on equine organs (particularly kidney and liver) as opposed to other tissues, such as muscle, (ii) what is the exact methodology and what are the specific testing mechanisms used to detect phenylbutazone and other drugs in horsemeat; (c) what surveys or studies has the government undertaken or relied on to determine the number of overall horse owners and keepers that have administered to horses under their care, even once in the horse's lifetime, substances that are banned for human consumption, in (i) Canada, (ii) the United States (US); (d) what surveys or studies encompassing the overall horse population has the government undertaken or relied on to determine the percentage of veterinarians who routinely administer to horse patients under their care, at any time in the horse's lifetime, substances that are banned for use in food animals, in (i) Canada, (ii) the US; (e) what was the ratio between the number of horses and the number of prescriptions of substances banned for use in food animals at any time in their lifetime, issued by veterinarians to the overall horse population in (i) Canada, (ii) the US; (f) what were the results of European ...

Alex Atamanenko: En ce qui concerne l’industrie de l’abattage des chevaux au Canada: a) le gouvernement sait-il s’il y a observation par des tiers des séquences vidéos à Viandes Richelieu et Bouvry Exports et, dans l'affirmative, (i) quels sont les critères d’observation, (ii) qui assure l’observation des séquences vidéos, (iii) quelles mesures a-t-on prises, le cas échéant, par suite des observations, (iv) l’observation des séquences vidéos sera-t-elle quotidienne à ces abattoirs et aux autres abattoirs de chevaux au Canada, (v) combien d’heures ont été observées, (vi) les séquences vidéos sont-elles archivées et pendant combien de temps, (vii) l’enregistrement se fait-il en boucle; b) quels types de tissus et(ou) de liquides organiques le gouvernement cible-t-il pour dépister la phénylbutazone et d’autres substances dans la viande de cheval, (i) quelle proportion du dépistage de substances se fait sur les organes équins (notamment les reins et le foie) par opposition à des tissus comme les muscles, (ii) par quelle méthodologie et quels mécanismes de dépistage détecte-t-on au juste la phénylbutazone et d’autres substances dans la viande de cheval; c) quelles enquêtes ou études le gouvernement a-t-il menées ou consultées pour déterminer le nombre de propriétaires ou de gardiens de chevaux ayant administré ne serait-ce qu’une fois à un animal sous leurs soins des substances interdites de consommation humaine (i) au Canada, (ii) aux États-Unis; d) quelles enquêtes ou études portant sur l’ensemble de la population chevaline le gouvernement a-t-il menées ou consultées pour déterminer le pourcentage de vétérinaires qui administrent couramment aux chevaux sous leurs soins ne serait-ce qu’une fois dans la vie de l’animal des substances dont l’administration aux animaux de boucherie est interdite (i) au Canada, (ii) aux États-Unis; e) quel était le rapport entre le nombre de chevaux et le nombre d’ordonnances de substances dont ...

‘Whereas the Ombudsman, who may also act on his own initiative, must have access to all the elements required for the performance of his duties; whereas to that end Community institutions and bodies are obliged to supply the Ombudsman, at his request, with any information which he requests of them and without prejudice to the Ombudsman's obligation not to divulge such information; whereas access to classified information or documents, in particular to sensitive documents within the meaning of Article 9 of Regulation (EC) No 1049/2001 (5), should be subject to compliance with the rules on security of the Community institution or body concerned; whereas the institutions or bodies supplying classified information or documents as mentioned in the first subparagraph of Article 3(2) should inform the Ombudsman of such classification; whereas for the implementation of the rules provided for in the first subparagraph of Article 3(2), the Ombudsman should have agreed in advance with the institution or body concerned the conditions for treatment of classified information or documents and other information covered by the obligation of professional secrecy; whereas if the Ombudsman finds that the assistance requested is not forthcoming, he shall inform the European Parliament, which shall make appropriate representations;

‘repair information’ means all information required for diagnosis, servicing, inspection, periodic monitoring or repair of the engine and which the manufacturers provide for their authorised dealers/repair shops. Where necessary, such information shall include service handbooks, technical manuals, diagnosis information (e.g. minimum and maximum theoretical values for measurements), wiring diagrams, the software calibration identification number applicable to an engine type, information enabling the update of the software of the electronic systems in accordance with the specifications of the vehicle manufacturer, instructions for individual and special cases, information provided concerning tools and equipment, data record information and two-directional monitoring and test data. The manufacturer shall not be obliged to make available that information which is covered by intellectual property rights or constitutes specific know-how of manufacturers and/or OEM suppliers; in this case the necessary technical information shall not be improperly withheld;
«informations de réparation», toutes les informations nécessaires au diagnostic, à l’entretien, au contrôle, à la révision périodique ou à la réparation du véhicule et mises par les constructeurs à la disposition de leurs revendeurs/garages agréés; ces informations incluent, au besoin, les manuels d’entretien, les instructions techniques, les données relatives au diagnostic (par exemple: valeurs minimales et maximales théoriques pour les mesures), les plans de montage, le numéro d’identification de l’étalonnage par logiciel applicable à un type de moteur, les données permettant la mise à jour du logiciel conformément aux spécifications du constructeur du véhicule, les instructions pour les cas individuels et spéciaux, les informations communiquées sur les outils et les appareils, les informations sur le contrôle des données, et les données d’essai et de contrôle bidirectionnelles; le constructeur n’est pas tenu de fournir les informations qui font l’objet de droits de propriété intellectuelle ou constituent un savoir-faire spécifique des fabricants et/ou des fournisseurs de l’équipement d’origine (OEM); dans ce cas, les informations techniques nécessaires ne sont pas refusées de façon abusive;

‘confidential information’ shall mean: (a) all non-public information regarding the proceedings and deliberations of the Procurement Committee; (b) all information contained in tender documents submitted by printing works and/or other third parties to the Procurement Committee; (c) all information which consists of trade secrets or other confidential or proprietary technical and/or business information related to euro banknote production; (d) information contained in the technical specifications for each euro banknote denomination; and (e) any other information regarding euro banknote production which is marked confidential or which by its nature a reasonable person would deem confidential;
