By Regulation (EC) No 993/2004 (7), the Council provided for the exemption from the anti-dumping duties of imports into the new Member States that acceded to the European Union on 1 May 2004 (the EU-10) made under the terms of special undertakings (enlargement undertakings), and authorised the Commission to accept those enlargement undertakings.

The ECJ makes do, however, in the case of the 1947 GATT Agreement (concluded prior to the EC Treaty, but binding under consistent ECJ judgments), with the interpretation that if individuals or Member States cite provisions of Community law as being in contravention of the GATT, it may only examine Community legal acts for their compatibility with the GATT if they were enacted in implementation of a special undertaking under the GATT or if they refer explicitly to specific provisions of the GATT.

This Regulation applies equally to all proceedings, whether the debtor is a natural person or a legal person, a trader or an individual. Insolvency proceedings concerning insurance undertakings, credit institutions, investment undertakings holding funds or securities for third parties and collective investment undertakings are excluded from the scope of this Regulation. Such undertakings are not covered by the Regulation since they are subject to special arrangements and, to some extent, the national supervisory authorities have extremely wide-ranging powers of intervention. With regard to insurance undertakings, however, special arrangements exist only for the original (direct) insurers . In the case of insolvency proceedings relating to a reinsurer, therefore, the general rules laid down in this regulation apply ;

(24) The abolition of special and exclusive rights in the telecommunications markets will allow undertakings enjoying special and exclusive rights in sectors other than telecommunications to enter the telecommunications markets. In order to allow for monitoring under the applicable rules of the Treaty of possible anti-competitive cross-subsidies between, on the one hand, areas for which providers of telecommunications services or telecommunications infrastructures enjoy special or exclusive rights and, on the other, their business as telecommunications providers, Member States should take the appropriate measures to achieve transparency as regards the use of resources from such protected activities to enter in the liberalized telecommunications market. Member States should at least require such undertakings once they achieve a significant turnover in the relevant telecommunications service and/or infrastructure provision market, to keep separate financial records, distinguishing between inter alia, costs and revenues associated with the provision of services under their special and exclusive rights and those provided under competitive conditions. For the time being, a turnover of more than ECU 50 million could be considered as a significant turnover.
(24) considérant que l'abolition des droits spéciaux et exclusifs sur le marché des télécommunications permettra à des entreprises bénéficiant de tels droits dans des secteurs autres que celui des télécommunications de prendre pied sur ce marché; que, afin de permettre le contrôle en vertu des règles pertinentes du traité, d'éventuelles subventions croisées abusives entre, d'une part, les domaines dans lesquels les fournisseurs de services ou d'infrastructures de télécommunications bénéficient de droits spéciaux ou exclusifs et, d'autre part, leurs activités sur le marché des télécommunications, les États membres devraient prendre les mesures nécessaires pour réaliser la transparence quant à l'utilisation des ressources provenant de ces domaines d'activités protégés pour pouvoir accéder au marché des télécommunications libéralisé; qu'il sera nécessaire, pour ce faire, d'imposer au minimum à ces entreprises de tenir, dès qu'elles réalisent un chiffre d'affaire significatif dans le marché concerné de la fourniture de services ou d'infrastructure de télécommunications, des comptes financiers distincts qui fassent apparaître séparément les produits et les charges liés aux services fournis en vertu de leurs droits spéciaux et exclusifs et ceux liés aux services fournis en situation de concurrence; que, à l'heure actuelle, un chiffre d'affaires de plus de 50 millions d'écus peut être considéré comme un chiffre d'affaires significatif;

12. Where the number of undertakings authorized to provide satellite telecommunications services is limited by a Member State through special rights, and a fortiori exclusive rights, these constitute restrictions that could be incompatible with Article 59 of the Treaty, whenever such limitation is not justified by essential requirements, since these rights prevent other undertakings from supplying (or obtaining) the services concerned to (or from) other Member States. In the case of satellite network services, such essential requirements could be the effective use of the frequency spectrum and the avoidance of harmful interference between satellite telecommunications systems a other space-based or terrestrial technical systems. Consequently, provided that equipment used to offer the services satisfies the essential requirement applicable to satellite communications, separate legal treatment of the latter is not justified. On the other hand, special rights consisting only in special legal or regulatory advantages, do not, in principle, preclude other undertakings from entering the market. The compatibility of these rights with the EC Treaty must therefore be assessed on a case-by-case basis, regard being had to their impact on the effective freedom of other entities to provide the same telecommunications service and their possible justifications regarding the activity concerned.

11. Telecommunications bodies or enterprises are undertakings within the meaning of Article 90 (1) because they carry on an organized business activity involving the production of goods or services. They are either public undertakings or private enterprises to which the Member States have granted special or exclusive rights for the importation, marketing, connection, bringing into service of telecommunications terminal equipment and/or maintenance of such equipment. The grant and maintenance of special and exclusive rights for terminal equipment constitute measures within the meaning of that Article. The conditions for applying the exception of Article 90 (2) are not fulfilled. Even if the provision of a telecommunications network for the use of the general public is a service of general economic interest entrusted by the State to the telecommunications bodies, the abolition of their special or exclusive rights to import and market terminal equipment would not obstruct, in law or in fact, the performance of that service. This is all the more true given that Member States are entitled to subject terminal equipment to type-approval procedures to ensure that they conform to the essential requirements.
11. considérant que les organismes ou entreprises de télécommunications sont des entreprises visées par l'article 90 paragraphe 1 puisqu'elles exercent de façon organisée une activité économique, et en particulier la production de biens et de services; qu'elles sont soit des entreprises publiques, soit des entreprises auxquelles les États ont octroyé des droits spéciaux ou exclusifs de raccordement, de mise en service d'appareils terminaux de télécommunication et/ou d'entretien de tels appareils d'importation, de commercialisation; que l'octroi et le maintien des droits spéciaux ou exclusifs en matière d'appareils terminaux constituent une mesure au sens de cet article; que les conditions d'application de l'exception prévue à l'article 90 paragraphe 2 ne sont pas remplies; que, même si la mise à la disposition de l'ensemble des consommateurs d'un réseau public de télécommunications constitue un service d'intérêt économique général dont ces organismes seraient chargés par acte public, la suppression des droits spéciaux ou exclusifs sur l'importation et sur la commercialisation d'appareils terminaux ne ferait pas échec en droit ou en fait à l'accomplissement de leur mission; que ceci est d'autant plus vrai que les États membres ont la faculté de soumettre les appareils terminaux à des procédures d'agrément afin de s'assurer de leur conformité avec les exigences essentielles;
