1. This Directive lays down the coordination and cooperation measures necessary to facilitate the exercise of the right set out in point (c) of Article 20(2) TFEU, of citizens of the Union to enjoy, in the territory of a third country in which the Member State of which they are nationals is not represented, the protection of the diplomatic and consular authorities of any Member State on the same conditions as the nationals of that Member State, also taking into account the role of Union delegations in contributing to the implementation of that right.

1. Member States shall ensure that suspects or accused persons who are non-nationals and who are deprived of liberty have the right to have the consular authorities of their State of nationality informed of the deprivation of liberty without undue delay and to communicate with those authorities, if they so wish. However, where suspects or accused persons have two or more nationalities, they may choose which consular authorities, if any, are to be informed of the deprivation of liberty and with whom they wish to communicate.

2. Verdachten of beklaagden hebben tevens het recht door hun consulaire autoriteiten te worden bezocht, zich met hen te onderhouden en met hen te corresponderen en het recht om hun vertegenwoordiging in rechte door hun consulaire autoriteiten geregeld te zien, voor zover die autoriteiten daarmee instemmen en de betrokken verdachten of beklaagden zulks wensen.

Suspects or accused persons also have the right to be visited by their consular authorities, the right to converse and correspond with them and the right to have legal representation arranged for by their consular authorities, subject to the agreement of those authorities and the wishes of the suspects or accused persons concerned.

whereas Article 20 of the EC Treaty, although unfortunately restricted to the situation where a citizen of a Member State is in the territory of a third country where that Member State is not represented, entitles every Union citizen to the diplomatic or consular protection of any Member State which is duly represented in that third country; whereas, that right cannot be properly exercised in the absence of clear and binding practical rules and protocols to be followed by the consular authorities,

Notes that the Vienna Convention on Consular Relations, to which all Member States are party, entitles suspects and defendants to consular assistance from the country of which they are a national, and that people should be made aware of this right, and the EU and Member States should work for the strengthening and modernisation of the Convention to give more effective protection eg. to make representations when safeguards are being violated and to represent a Member State's refugees and long-term residents who are not citizens of the European Union; notes that consular assistance, as provided for by the Vienna Convention, shall be guaranteed by the presence of an official who should be responsible for looking after the rights of suspects and defendants and should liaise with the families and lawyers of those concerned;
