Het Hof van Justitie van de Europese Unie heeft uitsluitende bevoegdheid voor alle kwesties betreffende de betrekkingen tussen de Commissie of het Agentschap en zijn personeel, wat betreft de toepassing van Verordening (EEG/Euratom/EGKS) nr. 259/68 van de Raad (2) en de andere bepalingen van het recht van de Europese Unie tot vaststelling van de arbeidsvoorwaarden.
The Court of Justice of the European Union shall have exclusive jurisdiction in any matters concerning relations between the Agency or the Commission and its staff with regard to the application of Regulation (EEC, Euratom, ECSC) No259/68 of the Council (2) and the other provisions of the European Union law laying down working conditions.

In gevallen die niet onder het recht van de Europese Unie vallen, wordt overeenkomstig het recht van de staat waar ESS ERIC zijn statutaire zetel heeft (op de datum van oprichting van ESS ERIC is dat het recht van Engeland en Wales) bepaald welk gerecht bevoegd is voor de beslechting van dergelijke geschillen.
In cases not covered by European Union legislation, the law of the State where the ESS ERIC has its statutory seat (i.e. the laws of England and Wales at the date of the establishment of the ESS ERIC) shall determine the competent jurisdiction for the resolution of such disputes.
