Tweede middel, ontleend aan een schending van artikel 13, lid 2, VEU door het opleggen van een correctie in verband met renteheffing zonder dat daarvoor een grondslag is aan te wijzen in het recht van de Europese Unie, en/of een onjuiste toepassing van het gelijkwaardigheidsbeginsel door aan te nemen dat Nederland ten tijde van de relevante feiten rente in rekening bracht over vergelijkbare nationale vorderingen.
