Points out that Member States are currently able to introduce obligatory health warnings for alcoholic beverages; recalls that front of pack labels may include the warnings that alcohol can cause serious health and mental health problems, that alcohol is addictive and that alcohol consumption during pregnancy may be harmful to the foetus; notes also that health warnings on alcohol may require European harmonisation similar to health warnings on tobacco and ask the Commission therefore to publish before 1 January 2010 either a legislative proposal to introduce health warnings on alcoholic beverages, or a communication to explain why in contrast to health warnings on tobacco, the introduction or harmonisation of health warnings on alcohol is not necessary; suggests that health warnings could in particular warn against the dangers related to alcohol consumption during pregnancy;

(3 bis) Het aandeel van niet uit landbouwproducten verkregen alcohol of synthetische alcohol in het verbruik van de EU bedraagt momenteel 50% en met uitzondering van alcoholhoudende dranken, die uitsluitend alcohol uit landbouwproducten bevatten, kunnen de overige bedrijfstakken zonder onderscheid, afhankelijk van de prijs en de vraag, gebruik kunnen maken van alcohol van verschillende oorsprong; het is duidelijk dat er tussen de beide soorten alcohol een aanzienlijke mate van concurrentie bestaat; derhalve moet informatie beschikbaar zijn over de markt voor niet uit landbouwproducten vervaardigde ethylalcohol.
(3a) Alcohol of non-agricultural origin, also known as synthetic alcohol, currently accounts for 50% of EU consumption and, except in the case of spirit drinks where alcohol of agricultural origin is used exclusively, other industries can use alcohol of different origins indiscriminately, depending on price and supply, so that to a large extent the two categories of alcohol are clearly in competition; accordingly, it would be appropriate to have information on the market in ethyl alcohol of non-agricultural origin.

(3 bis) overwegende dat het aandeel van niet uit landbouwproducten verkregen alcohol of synthetische alcohol in het verbruik van de EU momenteel 50% bedraagt en dat, met uitzondering van alcoholhoudende dranken, die uitsluitend alcohol uit landbouwproducten bevatten, de overige bedrijfstakken zonder onderscheid, afhankelijk van de prijs en de vraag, gebruik kunnen maken van alcohol van verschillende oorsprong, en dat het duidelijk is dat er tussen de beide soorten alcohol een aanzienlijke mate van concurrentie bestaat; dat derhalve informatie beschikbaar moet zijn over de markt voor niet uit landbouwproducten vervaardigde ethylalcohol.
(3a) Alcohol of non-agricultural origin, also known as synthetic alcohol, currently accounts for 50% of EU consumption and, except in the case of spirit drinks where alcohol of agricultural origin is used exclusively, other industries can use alcohol of different origins indiscriminately, depending on price and supply, so that to a large extent the two categories of alcohol are clearly in competition; accordingly, it would be appropriate to have information on the market in ethyl alcohol of non-agricultural origin.

4. Wanneer de koper of de in artikel 92 bedoelde erkende onderneming binnen de in de artikelen 85, 91 of 94 van deze verordening bedoelde maximumtermijn voor het afhalen van de betrokken partij alcohol constateert dat een hoeveelheid van de toegewezen alcohol niet voor het geplande gebruik geschikt is wegens verborgen gebreken die door de aard ervan in het kader van de vóór de toewijzing van de alcohol mogelijke controle niet konden worden ontdekt en deze constatering door het betrokken interventiebureau wordt bevestigd, kan de Commissie de koper een vervangende hoeveelheid alcohol voorstellen.
4. If a successful tenderer or approved firm finds, before the date set in Article 92, Article 85, Article 91 or Article 94 of this Regulation for removal of the lot of alcohol concerned, that a quantity of alcohol awarded is unsuitable for the uses planned owing to hidden defects that by their nature could not be discovered at the time when it was possible for a check to be made before the alcohol was awarded, the Commission may indicate a replacement quantity, in agreement with the relevant intervention agency, provided the latter confirms the tenderer's finding.

In geval van een inschrijving of een openbare verkoop voor alcohol die in de sector motorbrandstoffen moet worden gebruikt en waarbij het nodig is de afhaling en de verwerking van de alcohol over verscheidene jaren te spreiden, moet de door de koper geboden prijs per hectoliter alcohol 100 % vol driemaandelijks aan de hand van een in het betrokken bericht van inschrijving vermelde coëfficiënt worden herzien om de voor de toegewezen alcohol te betalen prijs te laten aansluiten bij de ontwikkeling van de brandstofprijzen op de wereldmarkt.
In the case of sale by tender or public sale for use as fuel, since physical removal and processing of the alcohol must take place over a period of several years, the price per hectolitre of alcohol at 100 % vol. offered by the successful tenderer should be adjusted every three months by applying a coefficient indicated in the relevant notice of invitation to tender, so that the prices to be paid for the alcohol awarded more closely follow the fluctuation of fuel prices on international markets.

(111) In geval van een inschrijving of een openbare verkoop voor alcohol die in de sector motorbrandstoffen moet worden gebruikt en waarbij het nodig is de afhaling en de verwerking van de alcohol over verscheidene jaren te spreiden, moet de door de koper geboden prijs per hectoliter alcohol 100 % vol driemaandelijks aan de hand van een in het betrokken bericht van inschrijving vermelde coëfficiënt worden herzien om de voor de toegewezen alcohol te betalen prijs te laten aansluiten bij de ontwikkeling van de brandstofprijzen op de wereldmarkt.

4. Voor producenten die wijn van hun eigen productie aan azijnfabrieken leveren, wordt de in zuivere alcohol uitgedrukte hoeveelheid alcohol die aanwezig is in de geleverde wijn, afgetrokken van de in zuivere alcohol uitgedrukte hoeveelheid alcohol in de wijn die op grond van de verplichting als bedoeld in artikel 27, lid 3, van Verordening (EG) nr. 1493/1999 voor distillatie moet worden geleverd.
4. In the case of producers who deliver wine of their own production to the vinegar industry, the amount of alcohol, expressed as pure alcohol, contained in the wine delivered shall be deducted from the amount of alcohol, expressed as pure alcohol, contained in the wine to be delivered for distillation to discharge the obligation referred to in Article 27(3) of Regulation (EC) No 1493/1999.

(117) Bij het vervoer over land en over zee en bij de verwerking van de alcohol vóór het eindgebruik kunnen bepaalde hoeveelheden alcohol verloren gaan; bij het beoordelen van de bij het laden en lossen van alcohol geconstateerde verschillen in het volume alcohol moet rekening worden gehouden met de terzake geldende technische normen en voor elk van de bovengenoemde verliezen moet een specifieke maximmumtolerantie worden vastgesteld.
(117) Losses may occur when alcohol is being transported by land and sea and processed prior to final use. Account should be taken of the relevant technical standards to evaluate changes in the volume of alcohol recorded on loading and unloading and a specific tolerance limit should be set for each category of loss.
