Voor de belangrijkste zeebekkens in de Uniewateren zijn momenteel drie gedetailleerde verordeningen inzake technische maatregelen van kracht, die volgens de gewone wetgevingsprocedure zijn vastgesteld, namelijk Verordening (EG) nr. 850/98 van de Raad van 30 maart 1998 voor de instandhouding van de visbestanden via technische maatregelen voor de bescherming van jonge exemplaren van mariene organismen, die betrekking heeft op het noordoostelijke deel van de Atlantische Oceaan (en sinds 2012 ook op de Zwarte Zee), Verordening (EG) nr. 1967/2006 van de Raad van 21 december 2006 inzake beheersmaatregelen voor de duurzame exploitatie van visbestanden in de Middellandse Zee, tot wijziging van Verordening (EEG) nr. 2847/93 en tot intrekking van Verordening (EG) nr. 1626/94; en Verordening (EG) nr. 2187/2005 van de Raad van 21 december 2005 betreffende de instandhouding door middel van technische maatregelen van de visbestanden in de Oostzee, de Belten en de Sont, tot wijziging van Verordening (EG) nr. 1434/98 en tot intrekking van Verordening (EG) nr. 88/98.
Currently there are three detailed technical measures regulations enacted under the ordinary legislative procedure covering the main sea basins in Union waters – Council Regulation (EC) No 850/98 of 30 March 1998 for the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms covering the North-east Atlantic (and the Black Sea since 2012); Council Regulation (EC) No 1967/2006 of 21 December 2006 concerning management measures for the sustainable exploitation of fishery resources in the Mediterranean Sea, amending Regulation (EEC) No 2847/93 and repealing Regulation (EC) No 1626/94; and Council Regulation (EC) No 2187/2005 of 21 December 2005 for the conservation of fishery resources through technical measures in the Baltic Sea, the Belts and the Sound, amending Regulation (EC) No 1434/98 and repealing Regulation (EC) No 88/98.

Bij Verordening (EG) nr. 850/98 van de Raad van 30 maart 1998 voor de instandhouding van de visbestanden via technische maatregelen voor de bescherming van jonge exemplaren van mariene organismen zijn technische instandhoudingsmaatregelen vastgesteld, zoals voorschriften inzake vangstsamenstelling, minimummaaswijdte, minimummaat bij aanlanding en voor de visserij gesloten gebieden en seizoenen.

Het Europees Parlement benadrukt echter dat die bepalingen niet als een precedent opgevat of gebruikt mogen worden in het kader van om het even welke verordening die wordt aangenomen in overeenstemming met de gewone wetgevingsprocedure, en met name het Commissievoorstel voor een verordening tot wijziging van Verordening (EG) nr. 850/98 van de Raad voor de instandhouding van de visbestanden via technische maatregelen voor de bescherming van jonge exemplaren van mariene organismen.
The European Parliament stresses, however, that those provisions are not to be taken or used as a precedent in any regulation adopted in accordance with the ordinary legislative procedure, in particular the Commission proposal for a regulation amending Council Regulation (EC) No 850/98 concerning the conservation of fishery resources through technical measures for the protection of juveniles of marine organisms.

Aangezien de instandhouding van visbestanden van primair belang is, en als tegenwicht voor de negatieve bijklank van het woord "exploitatie", moet worden verklaard dat de instandhouding van de visbestanden in de Middellandse Zee ook een doelstelling is van Verordening (EG) nr. 1967/2006, en moet deze doelstelling ook worden genoemd in de titel van Verordening (EG) nr. 1967/2006 en de wijzigingsverordening.
Since the conservation of fishery resources is of primary importance and in order to counterbalance the negative connotation of the term "exploitation", it seems appropriate to state that conservation of fishery resources in the Mediterranean is also an objective of Regulation (EC) No 1967/2006, and to make this objective appear in the title of Regulation (EC) No 1967/2006 and the amending regulation.

(11 bis) In het licht van het advies van de ICES en het WTECV moeten bepaalde technische instandhoudingsmaatregelen in de wateren ten westen van Schotland (ICES-sector VIa) om kabeljauw-, schelvis- en wijtingbestanden te beschermen, gehandhaafd blijven om aan de instandhouding van die visbestanden bij te dragen.
