The Commission considered that the risk of confusion between the Synthelabo and Syntex trademarks could not justify the partitioning of of the market and that, taking account of the size of the companies involved and the fact that their products are sold in various member states, the agreement fell within the provisions of Article 85(1).
Dans le cas d'espèce, la Commission a considéré que le risque de confusion entre les marques Synthelabo et Syntex ne justifiait pas le cloisonnement des marchés et que, compte tenu de l'importance des sociétés en cause et du fait que leurs produits étaient vendus dans plusieurs Etats membres, l'accord tombait sous le coup des dispositions de l'article 85 paragraphe 1.
