The ban on discrimination contained in Article 45 of the Treaty on the Functioning of the European Union covers not only overt discrimination on grounds of nationality but also all covert forms of discrimination which, by the application of other criteria of differentiation, lead in fact to the same result (see inter alia, EU Court judgment of 26 May 1996 in case C-237/94 O'Flynn).

The European Commission has welcomed the Council of Ministers agreement today on a directive banning racial discrimination at the workplace and beyond.

I. 1 Obligations under the Treaty of Rome A number of provisions in the Treaty concern public procurement: (a) the ban on discrimination on grounds of nationality (first paragraph of Article 7); (b) the ban on restrictions on the sale of products (Article 30), which also applies to all measures having equivalent effect, a concept interpreted by the Court of Justice as applying to all measures which are capable of hindering, directly or indirectly, actually or potentially, intra-Community trade (Dundalk and Du Pont de Nemours); (c) the freedom of establishment of nationals of a Member State in the other Member States (Article 52 et seq.); (d) the freedom, for nationals of Member States, to provide services in another Member State (Article 59 et seq.), as illustrated by the Court in Re Data Processing.
