Welcomes the resolutions passed by Parliament calling for the closure of the Guantánamo Bay detention centre and the contributions that Parliament has made to raising the profile of that centre and its human rights concerns relating thereto; calls on the Council and the Commission to urge the US Government to find a mechanism that will facilitate the charging or releasing of detainees in accordance with international law; welcomes the fact that, in May 2006, Albania became the first country to resettle five Chinese Uighurs from Guantánamo, but regrets that 13 Chinese Uighurs who have been cleared for release by the United States Government remain in Guantánamo Bay as the United States Government has rightly concluded that they cannot be returned to China for fear of torture; calls on the Council, the Commission and Member States to work with the United States Government to facilitate the settlement of all those remaining individuals who the United States has concluded pose no threat to the United States or its allies but who cannot be returned to their home countries for fear of torture; is concerned that the very existence of the Guantánamo Bay detention centre continues to send out a negative signal as to how the fight against terrorism is being pursued;
149. se félicite du fait que le Parlement ait adopté des résolutions appelant à la fermeture du centre de détention de Guantánamo, qu'il ait contribué à accroître la visibilité de ce centre et de ses préoccupations au sujet des problèmes de droits de l'homme qui s'y posent; invite le Conseil et la Commission à demander instamment au gouvernement des États-Unis de trouver un mécanisme facilitant la mise en examen ou la libération des détenus, conformément au droit international; se félicite de ce que, en mai 2006, l'Albanie soit devenue le premier pays à admettre cinq Ouïgours chinois venant de Guantánamo, mais regrette que 13 Ouïgours chinois relâchés par le gouvernement des États-Unis demeurent à Guantánamo, le gouvernement des États-Unis ayant à juste titre estimé qu'ils ne peuvent retourner en Chine de crainte de faire l'objet de tortures; demande au Conseil, à la Commission et aux États membres d'œuvrer avec le gouvernement des États-Unis pour faciliter la réinstallation de toutes les autres personnes dont ce dernier estime qu'elles ne constituent pas une menace pour les etats-Unis ni pour leurs alliés mais qui ne peuvent retourner dans leur pays d'origine en raison de risques de torture; est préoccupé par le fait que l'existence même du centre de détention de Guantánamo continue de représenter un mauvais exemple de la manière dont la lutte contre le terrorisme est menée;

Recalls the resolutions of Parliament calling for the closure of the Guantánamo Bay detention centre; calls on the Council and the Commission to urge the US Government to find a mechanism that will facilitate the charging or releasing of detainees in accordance with international law; is concerned that the very existence of the Guantánamo Bay detention centre continues to send out a negative signal as to how the fight against terrorism is being pursued; urges the Council to issue a clear and forceful declaration calling on the US Government to put an end to the practice of extraordinary arrests and renditions and that the US Government be requested for clarifications regarding the existence of secret prisons outside US territory;

With regard to the second part, alleging a breach of Article 27(4) of the Rules Governing the Payment of Expenses and Allowances, it must be stated at the outset that the contested decision comprises essentially two aspects, namely, first, the finding by the Secretary-General that the sums mentioned had been improperly paid to the applicant and that they had to be recovered and, secondly, the decision to effect recovery by means of offsetting against allowances payable to the applicant.
