Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. The codes should be used, as required, for each substance specified, but it should be noted that not all fourth character codes are applicable to all substances. Identification of the psychoactive substance should be based on as many sources of information as possible. These include self-report data, analysis of blood and other body fluids, characteristic physical and psychological symptoms, clinical signs and behaviour, and other evidence such as a drug being in the patient's possession or reports from informed third parties. Definition: A form of tic disorder in which there are, or have been, multiple motor tics and one or more vocal tics, although these need not have occurred concurrently. The disorder usually worsens during adolescence and tends to persist into adult life. The vocal tics are often multiple with explosive repetitive vocalizations, throat-clearing, and grunting, and there may be the use of obscene words or phrases. Similarly, the Court considers that the fact that the concentration transaction had no effect on the market is not a decisive factor for determining the gravity of the infringement in ex post facto merger control, and notes that the infringement lasted for a significant time. The Court also considers that the Commission was correct in finding that the fact that the infringement was committed through negligence need not give rise to a reduction in the fine. RECALLS that a measure applied to aviation and maritime transport should have the primary goal to allow for the sector to contribute through mitigation to the 2 degree objective established by the UNFCCC; REITERATES that the carbon pricing of global aviation and maritime transportation would generate the necessary price signal to efficiently achieve more emission reductions from these sectors and could generate large financial flows, as highlighted in the AGF and the G20 reports; In this context, TAKES NOTE of the Commission's work on carbon pricing of international aviation and maritime transport and the options under consideration in the context of ICAO and IMO for global measures to address emissions in the aviation and maritime sectors; CONCLUDES that a majority of those have the potential to generate a carbon price which could potentially also generate significant revenues; NOTES that finance available, including from auctions of aviation allowances in the EU ETS, could help to support climate action in developing countries while STRESSING that it will be up to each Member State to determine the use of public revenues in accordance with national budgetary rules and in consistency with a sound and sustainable public finances policy framework of the EU, without prejudging the ongoing negotiations at the IMO; WELCOMES an acceleration of work by ICAO to further develop options for global market-based measures to address aviation emissions; ENCOURAGES the EU and its Member States to further engage effectively in negotiations in ICAO and IMO to support carbon pricing schemes which primarily incentivise mitigation and also have the potential to generate revenue; and URGES all Parties to IMO and ICAO to further increase their efforts to make progress on market based mechanisms to address emissions from global aviation and maritime transportation.

Urges all Member States to collaborate fully in international criminal justice mechanisms, and especially in bringing fugitives to justice; in this regard, notes with satisfaction the cooperation of the Democratic Republic of the Congo in the transfer of Germain Katanga to the ICC, the cooperation of Serbia in the arrest and transfer of Zdravko Tolimir to the International Criminal Tribunal for the former Yugoslavia (ICTY) and the cooperation of Serbia and Montenegro in the arrest and transfer of Vlastimir Đjorđjević to the ICTY; however, notes with concern the persistent failure of Sudan to cooperate with the ICC by arresting and transferring Ahmad Muhammad Harun and Ali Muhammad Ali Abd-Al-Rahman; notes with concern that the ICC warrants for the arrest of four members of the Lord's Resistance Army in Uganda have not yet been executed; also notes with concern that Radovan Karadžić and Ratko Mladić remain at large and have not been brought before the ICTY; in this regard, calls on the Serbian authorities to ensure full cooperation with the ICTY, which should lead to the arrest and transfer of all remaining indictees, in order to open the way to the ratification of a Stabilisation and Association Agreement; considers further that the current proceedings brought against Liberia's former President, Charles Taylor, by the Special Court for Sierra Leone in The Hague constitute a significant development towards the ending of impunity;

Legislative proposals[27] have been adopted in order on the one hand to reinforce the right of female workers to maternity leave[28] and, on the other, to ensure equal treatment for self-employed workers and assisting spouses.[29] The Commission has noted the progress made by the Member States in improving the availability of childcare facilities (for 90% of children between the age of three and school age and for 33% of children aged under three).[30] It noted in its report that only a minority of Member States has achieved this objective.[31] Measures for developing childcare structures have been recommended, and have been included in the cohesion policy in particular.

Le CONSEIL, - PREND NOTE de la demande que lui a adressée la Commission, en date du 27 février 1995, relative aux observations éventuelles du Conseil sur le projet de directive de la Commission modifiant la directive 90/388/CEE concernant la suppression des restrictions à l'utilisation des réseaux câblés de télévision pour la fourniture de services de télécommunications ; - SOULIGNE que ce projet de texte est à apprécier à la lumière du Conseil "Télécommunications" du 17 novembre 1994 qui a abouti à la résolution du Conseil du 22 décembre 1994 et à des déclarations qui ont été effectuées à cette occasion ; - NOTE que, lors de l'examen de ce texte par les instances du Conseil, une série de questions complexes, dont les principaux thèmes sont repris en annexe, ont été posées à la Commission par les délégations ; - NOTE que la Commission, après avoir présenté de premiers éléments de réponse, s'est engagée à communiquer des réponses écrites plus précises ; - PREND NOTE du document de travail présenté par la Commission ; - PREND NOTE de la consultation publique lancée par la Commission à la suite de la publication de son projet de directive au Journal Officiel des Communautés européennes ; - INVITE les Etats membres qui le souhaitent à communiquer dans les meilleurs délais leurs commentaires détaillés à cette dernière et aux autres Etats membres, par l'intermédiaire du Secrétariat Général du Conseil, notamment au vu des réponses écrites de la Commission ; - SOULIGNE que les présentes conclusions ne préjugent pas des positions respectives des Etats membres sur la forme et le contenu du projet de directive présenté par la Commission ; - INVITE la Commission à tenir le plus grand compte de ces positions dans les suites qu'elle donnera à la procédure engagée.

CONSIDERANT QUE LES POSSIBILITES D'ADAPTATION OFFERTES PAR CET ARTICLE ONT CONDUIT A DES TRANSPOSITIONS DIFFERENTES DE LA DEFINITION ET DE SES NOTES INTERPRETATIVES DANS LES LEGISLATIONS DES ETATS MEMBRES ; QU'EN OUTRE, LES NOTES INTERPRETATIVES CONTIENNENT DES DISPOSITIONS DE NATURE FACULTATIVE QUI N'ONT PAS ETE RETENUES PAR TOUS LES ETATS MEMBRES OU QUI SONT APPLIQUEES DE FACON DIFFERENTE ;
