In the present case, the Tribunal considers that EPSO’s refusal to transmit to the applicant the version of the subject on which he was examined is justified by the need to rule out the possibility, in the event of other candidates also asking to receive the version of the subject on which they were examined, of their being able, by comparing those different versions, to determine, and subsequently make public, the methodology used in order to draw up the different versions of the same subject and the indicators used to assess the candidates.
Or, en l’espèce, le Tribunal estime que le refus de l’EPSO de communiquer au requérant la variante du sujet sur laquelle celui-ci a été interrogé est justifié par la nécessité d’éviter, dans le cas où d’autres candidats viendraient également à demander à recevoir la variante du sujet sur laquelle ils ont été interrogés, qu’il soit possible pour ceux-ci, en mettant en commun ces différentes variantes, de déterminer et, par suite, de rendre publics la méthodologie utilisée pour établir des variantes d’un même sujet ainsi que les indicateurs servant à évaluer les candidats.

– (FR) Mr President, ladies and gentlemen, I would like to ask you to consider that the exact and original wording of paragraph 35 of the resolution, which is put to the vote and which stresses that corporate social responsibility should include biodiversity, is the French version, and that that should be the version used. Moreover, the word ‘social’, which has disappeared from the English version, should be reinserted and the version corrected.
- Monsieur le Président, chers collègues. Je vous demande de considérer que la formulation exacte et originale du paragraphe 35 de la résolution qui est soumise au vote et qui souligne qu’il importe que la responsabilité sociale des entreprises intègre la biodiversité, que ce soit la version française qui soit prise en compte et que le mot «sociale», qui a disparu de la version anglaise, soit réintégré et que la version soit corrigée.

The Working Party is of the opinion that all different language versions of Article 3(1) of Regulation (EEC) No 2783/75 should be verified and that corrigenda should be published in respect of the English language version of that paragraph, as well as in respect of any other language versions that could contain that same mistake.

This version makes it possible to start operating high speed/high capacity international corridors in Europe as early as 2007 and is regarded as the common reference in the framework of the studies conducted by the European coordinator; considers that further efforts would make it possible to move in four or five years' time to a higher version; notes that in the framework of its "Change Control Management" process the European Railway Agency will have to assess the technical and economic relevance of such further developments, while abiding by the principle of continuity and upward and downward compatibility with version 2.3.0; believes that stabilisation and more extensive standardisation will enable system components to be manufactured in larger numbers, achieving economies of scale; considers that the price level, which today is up to eight times as high as the target prices originally specified, could then be reduced and ERTMS could be placed on an economically rational footing;
6. attire l'attention sur le fait que les spécifications fonctionnelles adoptées par le comité d'interopérabilité des États membres font de la norme 2.3.0 la référence, également pour l'Agence ferroviaire européenne; que cette version permet d'ouvrir dès 2007 des corridors internationaux à haute vitesse/haute capacité en Europe et est considérée comme la référence commune dans les études menées par le coordinateur européen; considère que des efforts supplémentaires permettraient de parvenir, dans quatre ou cinq ans, à une version plus élevée; observe que, dans le cadre de son processus de "gestion du contrôle du changement", l'Agence ferroviaire européenne devra évaluer l'opportunité technique et économique de cette évolution tout en respectant le principe de la continuité et de la compatibilité, en amont et en aval, avec la version 2.3.0; estime que seules la stabilisation et la poursuite de la standardisation permettront de renforcer le volume de la production des composants du système, réalisant des économies d'échelle; considère que le niveau des prix, qui atteint aujourd'hui huit fois les prix prévus à l'origine, pourrait ainsi être réduit, et l'ERTMS pourrait être placé sur une base économiquement saine;

– (IT) Mr President, considering that, in the Joint Statement on the EU-Russia summit, the versions are not compatible in that they contain different translations – the official version is the English one, which says ‘President of the European Council’, whilst the French and Portuguese versions say ‘Italian President of the Council’ – and, given the fact that the other versions could presumably contain the same error – ça va sans dire – and that the two definitions make the provisions below the aforementioned paragraph meaningless, I would like to ask whether, before proceeding to the vote, it would be possible to have all the versions brought into line, or, if not, if the vote on this resolution can be postponed to the next part-session in Brussels.
- (IT) Monsieur le Président, compte tenu que, dans la déclaration commune sur le sommet Union européenne - Russie, les différentes versions ne sont pas compatibles dans la mesure où elles comportent des traductions divergentes - la version officielle est la version anglaise qui dit "président en charge du Conseil de l’Europe", alors que les versions française et portugaise disent "président italien du Conseil" -, et dès lors que les autres versions pourraient présenter la même erreur - ça va sans dire - et que ces deux définitions rendent incompréhensibles les dispositions qui sous-tendent le paragraphe susmentionné, je vous demande, avant de passer au vote, s’il est possible d’aligner toutes les versions ou, dans le cas contraire, de reporter le vote sur cette résolution à la prochaine période de session de Bruxelles.
