1. Member States shall ensure that every network operator has the right to negotiate agreements concerning the coordination of civil works with undertakings providing or authorised to provide electronic communications networks with a view to deploying elements of high-speed electronic communications networks.

Stresses the importance of focusing on gender equality in the transition to a new sustainable economy, since women are more likely to be in an insecure position on the labour market owing to precarious employment conditions and a consistent gender-based wage gap; recognises the need for women to be given a choice as to the type of work they undertake, if they wish to work; calls for the development of labour market policies at Member State level which address the gender dimension, accompanied by programmes which empower and give confidence to women ; recalls that this can be achieved by providing a higher standard of education for girls and women in normally male-dominated subjects;

The responsibility of undertakings or groups of undertakings in the transmission of the information required to commence negotiations must be specified in a way that enables employees to determine whether the undertaking or group of undertakings where they work is a Community-scale undertaking or group of undertakings and to make the necessary contacts to draw up a request to commence negotiations.
La responsabilité d’une entreprise ou d’un groupe d’entreprises dans la transmission des informations nécessaires à l’ouverture de négociations doit être précisée de manière à permettre aux travailleurs de déterminer si l’entreprise ou le groupe d’entreprises où ils travaillent est de dimension communautaire et de prendre les contacts nécessaires à la formulation d’une demande d’ouverture des négociations.

5. Notwithstanding paragraph 2, where a Community-scale group of undertakings within the meaning of Article 2(1)(c) comprises one or more undertakings or groups of undertakings which are Community-scale undertakings or Community-scale groups of undertakings within the meaning of Article 2(1)(a) or (c), a European Works Council shall be established at the level of the group unless the agreements referred to in Article 6 provide otherwise.
